66 AN ACT
77 relating to the administration of assessment instruments to certain
88 students of limited English proficiency.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.023(l), Education Code, as effective
1111 until on or before September 1, 2015, is amended to read as follows:
1212 (l) The State Board of Education shall adopt rules for the
1313 administration of the assessment instruments adopted under
1414 Subsection (a) or the end-of-course assessment instruments adopted
1515 under Subsection (c) in Spanish to students in grades three through
1616 12 [five] who are of limited English proficiency, as defined by
1717 Section 29.052, whose primary language is Spanish, and who are not
1818 otherwise exempt from the administration of an assessment
1919 instrument under Section 39.027(a)(1) or (2). Each student of
2020 limited English proficiency whose primary language is Spanish,
2121 other than a student to whom Subsection (b) applies, may be assessed
2222 using assessment instruments in Spanish under this subsection [for
2323 up to three years] or assessment instruments in English under
2424 Subsection (a) or end-of-course assessment instruments in English
2525 under Subsection (c). The language proficiency assessment
2626 committee established under Section 29.063 shall determine which
2727 students are administered assessment instruments in Spanish under
2828 this subsection.
2929 SECTION 2. Section 39.023(l), Education Code, as effective
3030 on or before September 1, 2015, is amended to read as follows:
3131 (l) The State Board of Education shall adopt rules for the
3232 administration of the assessment instruments adopted under
3333 Subsection (a) or the end-of-course assessment instruments adopted
3434 under Subsection (c) and, to the extent applicable, the assessment
3535 instruments adopted under Subsection (a-4) in Spanish to students
3636 in grades three through 12 [, four, and five] who are of limited
3737 English proficiency, as defined by Section 29.052, whose primary
3838 language is Spanish, and who are not otherwise exempt from the
3939 administration of an assessment instrument under Section
4040 39.027(a)(1) or (2). Each student of limited English proficiency
4141 whose primary language is Spanish, other than a student to whom
4242 Subsection (b) applies, may be assessed using assessment
4343 instruments in Spanish under this subsection [for up to three
4444 years] or assessment instruments in English under Subsection (a) or
4545 end-of-course assessment instruments in English under Subsection
4646 (c) and, as applicable, Subsection (a-4). The language
4747 proficiency assessment committee established under Section 29.063
4848 shall determine which students are administered assessment
4949 instruments in Spanish under this subsection.
5050 SECTION 3. Section 39.023(l), Education Code, as effective
5151 September 1, 2017, is amended to read as follows:
5252 (l) The State Board of Education shall adopt rules for the
5353 administration of the assessment instruments adopted under
5454 Subsection (a) or the end-of-course assessment instruments adopted
5555 under Subsection (c) in Spanish to students in grades three through
5656 12 [five] who are of limited English proficiency, as defined by
5757 Section 29.052, whose primary language is Spanish, and who are not
5858 otherwise exempt from the administration of an assessment
5959 instrument under Section 39.027(a)(1) or (2). Each student of
6060 limited English proficiency whose primary language is Spanish,
6161 other than a student to whom Subsection (b) applies, may be assessed
6262 using assessment instruments in Spanish under this subsection [for
6363 up to three years] or assessment instruments in English under
6464 Subsection (a) or end-of-course assessment instruments in English
6565 under Subsection (c). The language proficiency assessment
6666 committee established under Section 29.063 shall determine which
6767 students are administered assessment instruments in Spanish under
6868 this subsection.
6969 SECTION 4. This Act applies beginning with the 2015-2016
7070 school year.
7171 SECTION 5. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2015.
