55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to contributions and expenditures made in connection with
88 a campaign for speaker of the house of representatives.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 302.017 and 302.019, Government Code,
1111 are repealed.
1212 SECTION 2. Section 302.021(a), Government Code, is amended
1313 to read as follows:
1414 (a) A speaker candidate or former speaker candidate commits
1515 an offense if the person:
1616 (1) knowingly fails to file the declaration of
1717 candidacy required by Section 302.0121;
1818 (2) knowingly fails to file the statement required by
1919 Section 302.013;
2020 (3) knowingly accepts a contribution, loan, or promise
2121 of a contribution or loan in violation of Section 302.0121(c);
2222 (4) [knowingly accepts a contribution, loan, or
2323 promise of a contribution or loan prohibited by Section 302.017
2424 from a corporation, partnership, association, firm, union,
2525 foundation, committee, club, or other organization or group of
2626 persons;
2727 [(5)] knowingly accepts a contribution from a person
2828 who uses political contributions, interest earned on political
2929 contributions, or an asset purchased with political contributions
3030 to make the contribution in violation of Section 302.0191;
3131 (5) [(6)] expends campaign funds for any purpose other
3232 than those enumerated in Section 302.020;
3333 (6) [(7)] knowingly retains contributions, assets
3434 purchased with contributions, or interest or other income earned on
3535 contributions in violation of Section 302.0201(b); or
3636 (7) [(8)] knowingly fails to file the report of
3737 unexpended campaign funds as required by Section 302.0201(d).
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2015.
