| 7 | 7 | | relating to contributions and expenditures made in connection with |
|---|
| 8 | 8 | | a campaign for speaker of the house of representatives. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Sections 302.017 and 302.019, Government Code, |
|---|
| 11 | 11 | | are repealed. |
|---|
| 12 | 12 | | SECTION 2. Section 302.021(a), Government Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (a) A speaker candidate or former speaker candidate commits |
|---|
| 15 | 15 | | an offense if the person: |
|---|
| 16 | 16 | | (1) knowingly fails to file the declaration of |
|---|
| 17 | 17 | | candidacy required by Section 302.0121; |
|---|
| 18 | 18 | | (2) knowingly fails to file the statement required by |
|---|
| 19 | 19 | | Section 302.013; |
|---|
| 20 | 20 | | (3) knowingly accepts a contribution, loan, or promise |
|---|
| 21 | 21 | | of a contribution or loan in violation of Section 302.0121(c); |
|---|
| 22 | 22 | | (4) [knowingly accepts a contribution, loan, or |
|---|
| 23 | 23 | | promise of a contribution or loan prohibited by Section 302.017 |
|---|
| 24 | 24 | | from a corporation, partnership, association, firm, union, |
|---|
| 25 | 25 | | foundation, committee, club, or other organization or group of |
|---|
| 26 | 26 | | persons; |
|---|
| 27 | 27 | | [(5)] knowingly accepts a contribution from a person |
|---|
| 28 | 28 | | who uses political contributions, interest earned on political |
|---|
| 29 | 29 | | contributions, or an asset purchased with political contributions |
|---|
| 30 | 30 | | to make the contribution in violation of Section 302.0191; |
|---|
| 31 | 31 | | (5) [(6)] expends campaign funds for any purpose other |
|---|
| 32 | 32 | | than those enumerated in Section 302.020; |
|---|
| 33 | 33 | | (6) [(7)] knowingly retains contributions, assets |
|---|
| 34 | 34 | | purchased with contributions, or interest or other income earned on |
|---|
| 35 | 35 | | contributions in violation of Section 302.0201(b); or |
|---|
| 36 | 36 | | (7) [(8)] knowingly fails to file the report of |
|---|
| 37 | 37 | | unexpended campaign funds as required by Section 302.0201(d). |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2015. |
