55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disposition of permit fees for the movement of
88 oversize or overweight vehicles on certain highways.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 623.323, Transportation Code, as added
1111 by Chapter 635 (H.B. 474), Acts of the 83rd Legislature, Regular
1212 Session, 2013, is amended by amending Subsection (b) and adding
1313 Subsection (c) to read as follows:
1414 (b) Of each fee [Fees] collected under Subsection (a), the
1515 authority:
1616 (1) may retain 15 percent for administrative costs;
1717 and
1818 (2) shall send to be used only for the construction and
1919 maintenance of the roads described by or designated under this
2020 subchapter:
2121 (A) 60 percent [Section 623.322 and for the
2222 authority's administrative costs, which may not exceed 15 percent
2323 of the fees collected. The authority shall make payments] to the
2424 Texas Department of Transportation; and
2525 (B) 25 percent to the municipalities responsible
2626 for maintenance of those roads [to provide funds for the
2727 maintenance of roads and highways subject to this subchapter].
2828 (c) The distribution made to a municipality under
2929 Subsection (b)(2)(B) is based on the percentage of miles of road
3030 maintained by the municipality as compared to the total miles of
3131 road maintained by all municipalities.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2015.
