44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to authorizing the issuance of revenue bonds for a
77 multipurpose education building at Lamar State College--Port
88 Arthur.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Section 55.1784 to read as follows:
1212 Sec. 55.1784. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
1313 BONDS. (a) In addition to the other authority granted by this
1414 subchapter, the board of regents of the Texas State University
1515 System may acquire, purchase, construct, improve, renovate,
1616 enlarge, or equip property and facilities, including roads and
1717 related infrastructu
1818 re, for the construction and remodeling of the
1919 Technology Building at Lamar State College--Port Arthur, to be
2020 financed through the issuance of bonds in accordance with this
2121 subchapter and in accordance with a system wide revenue financing
2222 program adopted by the board, in an aggregate principal amount not
2323 to exceed $9.6 million.
2424 (b) The board may pledge irrevocably to the payment of bonds
2525 authorized by this section all or any part of the revenue funds of
2626 an institution, branch, or entity of the Texas State University
2727 System, including student tuition charges. The amount of a pledge
2828 made under this subsection may not be reduced or abrogated while the
2929 bonds for which the pledge is made, or bonds issued to refund those
3030 bonds, are outstanding.
3131 (c) If sufficient funds are not available to the board to
3232 meet its obligations under this section, the board may transfer
3333 funds among institutions, branches, and entities of the Texas
3434 State University System to ensure the most equitable and efficient
3535 allocation of available resources for each institution, branch, or
3636 entity to carry out its duties and purposes.
3737 SECTION 2. This Act does not affect any authority or
3838 restriction regarding the activities that a public institution of
3939 higher education may conduct in connection with a facility financed
4040 by bonds authorized by this Act.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2015.
