6	6	AN ACT
7	7	relating to prohibition of notification forms from health benefit
8	8	plan issuers intended to intimidate patients; adding a provision
9	9	subject to a criminal penalty.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 843.363, Insurance Code, is amended by
12	12	adding Subsection (a-1) to read as follows:
13	13	(a-1) A health maintenance organization may not, as a
14	14	condition of payment with a physician, dentist, or provider, or in
15	15	any other manner, require a physician, dentist, or provider to
16	16	provide a notification form stating that the physician, dentist, or
17	17	provider is not a participating provider to a current, prospective,
18	18	or former patient, or a person designated by the patient, if the
19	19	form contains additional information that is intended, or is
20	20	otherwise required to be presented in a manner that is intended, to
21	21	intimidate the patient.
22	22	SECTION 2. Section 1301.067, Insurance Code, is amended by
23	23	adding Subsection (a-1) to read as follows:
24	24	(a-1) An insurer may not, as a condition of payment with a
25	25	physician or health care provider or in any other manner, require a
26	26	physician or health care provider to provide a notification form
27	27	stating that the physician or health care provider is not a
28	28	preferred provider to a current, prospective, or former patient, or
29	29	a person designated by the patient, if the form contains additional
30	30	information that is intended, or is otherwise required to be
31	31	presented in a manner that is intended, to intimidate the patient.
32	32	SECTION 3. This Act takes effect September 1, 2015.
