66 AN ACT
77 relating to prohibition of notification forms from health benefit
88 plan issuers intended to intimidate patients; adding a provision
99 subject to a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 843.363, Insurance Code, is amended by
1212 adding Subsection (a-1) to read as follows:
1313 (a-1) A health maintenance organization may not, as a
1414 condition of payment with a physician, dentist, or provider, or in
1515 any other manner, require a physician, dentist, or provider to
1616 provide a notification form stating that the physician, dentist, or
1717 provider is not a participating provider to a current, prospective,
1818 or former patient, or a person designated by the patient, if the
1919 form contains additional information that is intended, or is
2020 otherwise required to be presented in a manner that is intended, to
2121 intimidate the patient.
2222 SECTION 2. Section 1301.067, Insurance Code, is amended by
2323 adding Subsection (a-1) to read as follows:
2424 (a-1) An insurer may not, as a condition of payment with a
2525 physician or health care provider or in any other manner, require a
2626 physician or health care provider to provide a notification form
2727 stating that the physician or health care provider is not a
2828 preferred provider to a current, prospective, or former patient, or
2929 a person designated by the patient, if the form contains additional
3030 information that is intended, or is otherwise required to be
3131 presented in a manner that is intended, to intimidate the patient.
3232 SECTION 3. This Act takes effect September 1, 2015.
