| 6 | 6 | | relating to rules which insure that local independent school |

| 7 | 7 | | district selection of non-state adopted instructional materials to |

| 8 | 8 | | be purchased with state funds, is as accountable and transparent as |
|---|
| 9 | 9 | | the State Board of Education approval process for state-adopted |
|---|
| 10 | 10 | | instructional materials. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 31.003, Education Code, is amended by |
|---|
| 13 | 13 | | designating the current rule as Subsection (a) and adding |
|---|
| 14 | 14 | | Subsections (b), (b-1), (b-2), (b-3), (b-4), (b-5), and (b-6) to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | (a) The State Board of Education may adopt rules, consistent |
|---|
| 17 | 17 | | with this chapter, for the adoption, requisition, distribution, |
|---|
| 18 | 18 | | care, use, and disposal of instructional materials. |
|---|
| 19 | 19 | | (b) The State Board of Education may by rule set minimum |
|---|
| 20 | 20 | | standards for local procedures selecting non-state adopted |
|---|
| 21 | 21 | | instructional materials to be purchased with state funds only in |
|---|
| 22 | 22 | | the areas of: |
|---|
| 23 | 23 | | (1) public notice, access, and input; |
|---|
| 24 | 24 | | (2) review by independent panel to determine coverage |
|---|
| 25 | 25 | | of the essential knowledge and skills; |
|---|
| 26 | 26 | | (3) prevention/correction of factual errors; |
|---|
| 27 | 27 | | (4) coverage of essential knowledge and skills in the |
|---|
| 28 | 28 | | student version as well as in the teacher version of instructional |
|---|
| 29 | 29 | | materials, pursuant to TEC 31.023(a); |
|---|
| 30 | 30 | | (5) compliance with the stated purpose of TEC |
|---|
| 31 | 31 | | 28.002(h); and |
|---|
| 32 | 32 | | (6) safeguards against corruption. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2015. |
