96 relating to eligibility for supplemental financial assistance
107 provided to certain grandparents.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 31.0041, Human Resources Code, is
1310 amended by amending Subsection (a), as amended by S.B. No. 219, Acts
1411 of the 84th Legislature, Regular Session, 2015, and adding
1512 Subsection (a-1) to read as follows:
1613 (a) To the extent funds are appropriated for this purpose,
1714 the commission may provide supplemental financial assistance in
1815 addition to the amount of financial assistance granted for the
1916 support of a dependent child under Section 31.003 to a person who:
2017 (1) is 45 years of age or older;
2118 (2) is the grandparent of the dependent child, as
2219 defined by Section 31.002, who lives at the person's residence;
2320 (3) is the primary caretaker of the dependent child;
2421 (4) has a family income that is at or below 200 percent
2522 of the federal poverty level; and
2623 (5) subject to Subsection (a-1), does not have
2724 resources that exceed the amount allowed for financial assistance
2825 under this chapter.
2926 (a-1) Notwithstanding Section 31.032(d)(2), in determining
3027 whether a person is eligible for supplemental financial assistance
31- under this section, the department shall exclude from the person's
28+ under this section, the commission shall exclude from the person's
3229 available resources the fair market value of the ownership interest
3330 of the applicant or a member of the applicant's household in a motor
3431 vehicle.
3532 SECTION 2. Section 31.0041, Human Resources Code, as
3633 amended by this Act, applies only to a determination of eligibility
3734 of a person for supplemental financial assistance under that
3835 section that is made on or after the effective date of this Act.
3936 SECTION 3. If before implementing any provision of this Act
4037 a state agency determines that a waiver or authorization from a
4138 federal agency is necessary for implementation of that provision,
4239 the agency affected by the provision shall request the waiver or
4340 authorization and may delay implementing that provision until the
4441 waiver or authorization is granted.
4542 SECTION 4. This Act takes effect immediately if it receives
4643 a vote of two-thirds of all the members elected to each house, as
4744 provided by Section 39, Article III, Texas Constitution. If this
4845 Act does not receive the vote necessary for immediate effect, this
4946 Act takes effect September 1, 2015.
