| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 86.007(d), (e), and (f), Election Code, |
|---|
| 10 | 10 | | are amended to read as follows: |
|---|
| 11 | 11 | | (d) A marked ballot voted by mail that arrives after the |
|---|
| 12 | 12 | | time prescribed by Subsection (a) shall be counted if: |
|---|
| 13 | 13 | | (1) [the ballot was cast from an address outside the |
|---|
| 14 | 14 | | United States; |
|---|
| 15 | 15 | | [(2)] the carrier envelope was placed for delivery |
|---|
| 16 | 16 | | before the time the ballot is required to arrive under Subsection |
|---|
| 17 | 17 | | (a); and |
|---|
| 18 | 18 | | (2) [(3)] the ballot arrives at the address on the |
|---|
| 19 | 19 | | carrier envelope not later than the fifth day after the date of the |
|---|
| 20 | 20 | | election, except that if that date falls on a Saturday, Sunday, or |
|---|
| 21 | 21 | | legal state or national holiday, then the deadline is extended to |
|---|
| 22 | 22 | | the next regular business day. |
|---|
| 23 | 23 | | (e) A delivery under Subsection (d)(1) [(d)(2)] is timely, |
|---|
| 24 | 24 | | except as otherwise provided by this title, if the carrier envelope |
|---|
| 25 | 25 | | or, if applicable, the envelope containing the carrier envelope: |
|---|
| 26 | 26 | | (1) is properly addressed with postage or handling |
|---|
| 27 | 27 | | charges prepaid; and |
|---|
| 28 | 28 | | (2) [is sent from an address outside the United |
|---|
| 29 | 29 | | States; and |
|---|
| 30 | 30 | | [(3)] bears a cancellation mark of a recognized postal |
|---|
| 31 | 31 | | service or a receipt mark of a common or contract carrier or a |
|---|
| 32 | 32 | | courier indicating a time before the deadline. |
|---|
| 33 | 33 | | (f) If the envelope does not bear the cancellation mark or |
|---|
| 34 | 34 | | receipt mark as required by Subsection (e)(2) [(e)(3)], a delivery |
|---|
| 35 | 35 | | from an address outside the United States [under Subsection (d)(1)] |
|---|
| 36 | 36 | | is presumed to be timely if the other requirements under this |
|---|
| 37 | 37 | | section are met. [Section 1.006 does not apply to Subsection |
|---|
| 38 | 38 | | (d)(3).] |

| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2015. |
