| 12 | 5 | | relating to the use of municipal hotel occupancy tax revenue in |

| 13 | 6 | | certain municipalities. |

| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Section 351.101, Tax Code, is amended by adding |
|---|
| 16 | 9 | | Subsection (h) to read as follows: |
|---|
| 17 | 10 | | (h) In addition to the uses authorized by Subsection (a), a |
|---|
| 18 | 11 | | municipality described by Subsection (a)(7)(B)(viii), as added by |
|---|
| 19 | 12 | | Chapter 546 (S.B. 585), Acts of the 83rd Legislature, Regular |
|---|
| 20 | 13 | | Session, 2013, may use revenue derived from the tax authorized by |
|---|
| 21 | 14 | | this chapter to promote tourism and the convention and hotel |
|---|
| 22 | 15 | | industry by constructing, maintaining, or expanding a |
|---|
| 23 | 16 | | sporting-related facility owned by the municipality if: |
|---|
| 24 | 17 | | (1) the majority of the events at the facility involve |
|---|
| 25 | 18 | | participants staying at hotels in the municipality; and |
|---|
| 26 | 19 | | (2) for a fiscal year, the municipality does not |
|---|
| 27 | 20 | | reduce the amount of that revenue that it uses for a purpose |
|---|
| 28 | 21 | | described by Subsection (a)(3) to an amount that is less than the |
|---|
| 29 | 22 | | lesser of: |
|---|
| 30 | 23 | | (A) the amount of that revenue used by the |
|---|
| 31 | 24 | | municipality for that purpose during the municipality's 2015 fiscal |
|---|
| 32 | 25 | | year; or |
|---|
| 33 | 26 | | (B) the total amount of that revenue received in |
|---|
| 34 | 27 | | the fiscal year. |
|---|
| 35 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 32 | | Act takes effect September 1, 2015. |
