11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter F, Chapter 2306, Government Code, is |
---|
13 | 13 | | amended by adding Section 2306.11141 to read as follows: |
---|
14 | 14 | | Sec. 2306.11141. PROMPT REVIEW OF CERTAIN APPLICATIONS; |
---|
15 | 15 | | TECHNICAL ASSISTANCE. To enable an applicant to complete in a |
---|
16 | 16 | | prompt and compliant manner an environmental review required for an |
---|
17 | 17 | | award of financial assistance under the terms of the federal HOME |
---|
18 | 18 | | Investment Partnerships Program established under Title II of the |
---|
19 | 19 | | Cranston-Gonzalez National Affordable Housing Act (42 U.S.C. |
---|
20 | 20 | | Section 12701 et seq.), the department shall: |
---|
21 | 21 | | (1) not later than the 90th day after the date of |
---|
22 | 22 | | receipt of the application, review any substantially complete |
---|
23 | 23 | | application for that assistance; and |
---|
24 | 24 | | (2) provide to the applicant any necessary technical |
---|
25 | 25 | | assistance. |
---|
26 | 26 | | SECTION 2. Subchapter J, Chapter 2306, Government Code, is |
---|
27 | 27 | | amended by adding Section 2306.233 to read as follows: |
---|
28 | 28 | | Sec. 2306.233. PREDEVELOPMENT LOANS. (a) Provided the |
---|
29 | 29 | | activity is identified by the department as a planned activity in |
---|
30 | 30 | | the consolidated plan, the department may issue to a community |
---|
31 | 31 | | housing development organization certified by the department a |
---|
32 | 32 | | project-specific predevelopment loan to facilitate an activity |
---|
33 | 33 | | necessary to develop a project that, if considered feasible, will |
---|
34 | 34 | | receive an award of financial assistance under the terms of the |
---|
35 | 35 | | federal HOME Investment Partnerships Program established under |
---|
36 | 36 | | Title II of the Cranston-Gonzalez National Affordable Housing Act |
---|
37 | 37 | | (42 U.S.C. Section 12701 et seq.). |
---|
38 | 38 | | (b) A predevelopment loan issued under this section may not |
---|
39 | 39 | | be used to pay: |
---|
40 | 40 | | (1) project costs that exceed customary and reasonable |
---|
41 | 41 | | project preparation costs; or |
---|
42 | 42 | | (2) administrative expenses of a community housing |
---|
43 | 43 | | development organization. |
---|
44 | 44 | | SECTION 3. This Act takes effect September 1, 2015. |
