44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to administration of a justice court technology fund in
77 certain counties by a justice of the peace council.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 102.0173, Code of Criminal Procedure, is
1010 amended by amending Subsections (e) and (f) and adding Subsection
1111 (g) to read as follows:
1212 (e) The justice court technology fund shall be administered
1313 by or under the direction of:
1414 (1) a justice of the peace council composed of five or
1515 more members; or
1616 (2) if a county does not have a council described by
1717 Subdivision (1), the commissioners court of the county.
1818 (f) A justice court may, subject to the approval of the
1919 entity that administers the justice court technology fund, as
2020 provided by Subsection (e) [commissioners court], use a fund
2121 designated by this article to assist a constable's office or other
2222 county department with a technological enhancement, or cost related
2323 to the enhancement, described by Subsection (d)(1) or (2) if the
2424 enhancement directly relates to the operation or efficiency of the
2525 justice court. This subsection applies only to a county that:
2626 (1) has a population of 125,000 or more;
2727 (2) is not adjacent to a county of two million or more;
2828 (3) contains a portion of the Guadalupe River; and
2929 (4) contains a portion of Interstate Highway 10.
3030 (g) In this article, "justice of the peace council" means a
3131 council formed by and composed of members who serve as a justice of
3232 the peace in the same county.
3333 SECTION 2. This Act takes effect September 1, 2015.
