| 7 | 7 | | certain counties by a justice of the peace council. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Article 102.0173, Code of Criminal Procedure, is |
|---|
| 10 | 10 | | amended by amending Subsections (e) and (f) and adding Subsection |
|---|
| 11 | 11 | | (g) to read as follows: |
|---|
| 12 | 12 | | (e) The justice court technology fund shall be administered |
|---|
| 13 | 13 | | by or under the direction of: |
|---|
| 14 | 14 | | (1) a justice of the peace council composed of five or |
|---|
| 15 | 15 | | more members; or |
|---|
| 16 | 16 | | (2) if a county does not have a council described by |
|---|
| 17 | 17 | | Subdivision (1), the commissioners court of the county. |
|---|
| 18 | 18 | | (f) A justice court may, subject to the approval of the |
|---|
| 19 | 19 | | entity that administers the justice court technology fund, as |
|---|
| 20 | 20 | | provided by Subsection (e) [commissioners court], use a fund |
|---|
| 21 | 21 | | designated by this article to assist a constable's office or other |
|---|
| 22 | 22 | | county department with a technological enhancement, or cost related |
|---|
| 23 | 23 | | to the enhancement, described by Subsection (d)(1) or (2) if the |
|---|
| 24 | 24 | | enhancement directly relates to the operation or efficiency of the |
|---|
| 25 | 25 | | justice court. This subsection applies only to a county that: |
|---|
| 26 | 26 | | (1) has a population of 125,000 or more; |
|---|
| 27 | 27 | | (2) is not adjacent to a county of two million or more; |
|---|
| 28 | 28 | | (3) contains a portion of the Guadalupe River; and |
|---|
| 29 | 29 | | (4) contains a portion of Interstate Highway 10. |
|---|
| 30 | 30 | | (g) In this article, "justice of the peace council" means a |
|---|
| 31 | 31 | | council formed by and composed of members who serve as a justice of |
|---|
| 32 | 32 | | the peace in the same county. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2015. |
