44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prohibited conduct by insurance adjusters, public
77 insurance adjusters, and contractors.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 4101, Insurance Code, is amended by
1010 amending Subchapter F to read as follows:
1111 SUBCHAPTER F. PROHIBITED CONDUCT
1212 Sec. 4101.251. CERTAIN [ROOFING] CONTRACTOR-RELATED
1313 BUSINESS PROHIBITED. (a) An insurance adjuster licensed under
1414 this chapter may not adjust a loss related to [roofing] property
1515 damage on behalf of an insurer if the adjuster is a [roofing]
1616 contractor or otherwise provides [roofing] contracting services
1717 for compensation, or is a controlling person in a [roofing]
1818 contracting-related business.
1919 (b) A [roofing] contractor may not act as an adjuster or
2020 advertise to adjust claims for any property for which the
2121 contractor is providing or may provide [roofing] services,
2222 regardless of whether the contractor holds a license under this
2323 chapter.
2424 (c) The commissioner shall adopt rules necessary to
2525 implement and enforce this section.
2626 SECTION 2. Subchapter D, Chapter 4102, Section 4102.163,
2727 Insurance Code, is amended to read as follows:
2828 Sec. 4102.163. CERTAIN [ROOFING] CONTRACTOR-RELATED
2929 BUSINESS PROHIBITED. (a) A [roofing] contractor may not act as a
3030 public adjuster or advertise to adjust claims for any property for
3131 which the contractor is providing or may provide [roofing]
3232 contracting services, regardless of whether the contractor holds a
3333 license under this chapter.
3434 (b) The commissioner shall adopt rules necessary to
3535 implement and enforce this section.
3636 SECTION 3. This Act takes effect September 1, 2015.
