| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 4101, Insurance Code, is amended by |
|---|
| 10 | 10 | | amending Subchapter F to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER F. PROHIBITED CONDUCT |
|---|
| 12 | 12 | | Sec. 4101.251. CERTAIN [ROOFING] CONTRACTOR-RELATED |
|---|
| 13 | 13 | | BUSINESS PROHIBITED. (a) An insurance adjuster licensed under |
|---|
| 14 | 14 | | this chapter may not adjust a loss related to [roofing] property |
|---|
| 15 | 15 | | damage on behalf of an insurer if the adjuster is a [roofing] |
|---|
| 16 | 16 | | contractor or otherwise provides [roofing] contracting services |
|---|
| 17 | 17 | | for compensation, or is a controlling person in a [roofing] |
|---|
| 18 | 18 | | contracting-related business. |
|---|
| 19 | 19 | | (b) A [roofing] contractor may not act as an adjuster or |
|---|
| 20 | 20 | | advertise to adjust claims for any property for which the |
|---|
| 21 | 21 | | contractor is providing or may provide [roofing] services, |
|---|
| 22 | 22 | | regardless of whether the contractor holds a license under this |
|---|
| 23 | 23 | | chapter. |
|---|
| 24 | 24 | | (c) The commissioner shall adopt rules necessary to |
|---|
| 25 | 25 | | implement and enforce this section. |
|---|
| 26 | 26 | | SECTION 2. Subchapter D, Chapter 4102, Section 4102.163, |
|---|
| 27 | 27 | | Insurance Code, is amended to read as follows: |
|---|
| 28 | 28 | | Sec. 4102.163. CERTAIN [ROOFING] CONTRACTOR-RELATED |
|---|
| 29 | 29 | | BUSINESS PROHIBITED. (a) A [roofing] contractor may not act as a |
|---|
| 30 | 30 | | public adjuster or advertise to adjust claims for any property for |
|---|
| 31 | 31 | | which the contractor is providing or may provide [roofing] |
|---|
| 32 | 32 | | contracting services, regardless of whether the contractor holds a |
|---|
| 33 | 33 | | license under this chapter. |
|---|
| 34 | 34 | | (b) The commissioner shall adopt rules necessary to |
|---|
| 35 | 35 | | implement and enforce this section. |

| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2015. |
