66 AN ACT
77 relating to the temporary continuation of utility service for real
88 property of a decedent.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 152, Estates Code, is amended by adding
1111 Subchapter D to read as follows:
1212 SUBCHAPTER D. TEMPORARY CONTINUATION OF UTILITY SERVICE
1313 Sec. 152.151. TEMPORARY CONTINUATION OF UTILITY SERVICE.
1414 (a) A decedent's next of kin may submit to an entity that provides
1515 or provided utility service to real property of the decedent a
1616 request that the entity continue the service until the earlier of:
1717 (1) the 90th day after the date the entity receives the
1818 request;
1919 (2) the 14th day after the date a personal
2020 representative of the decedent's estate qualifies; or
2121 (3) the date the next of kin requests that the service
2222 be discontinued.
2323 (b) An entity that receives a request described by
2424 Subsection (a):
2525 (1) is not required to comply with the request unless
2626 the decedent's next of kin submits with the request an electronic or
2727 paper copy of the decedent's death certificate; and
2828 (2) shall suspend imposition and collection of
2929 penalties or fees associated with nonpayment during the period the
3030 entity provides the requested service.
3131 (c) Next of kin who request service under this section are
3232 not personally liable for costs associated with continuing the
3333 service as described by this section. Costs associated with
3434 service requested under this section are a liability of the
3535 decedent's estate.
3636 (d) As soon as possible after the date a personal
3737 representative of the decedent's estate qualifies, the next of kin
3838 who requested service under this section shall notify the entity of
3939 that fact.
4040 SECTION 2. The changes in law made by this Act apply only to
4141 utility service of a decedent who dies on or after the effective
4242 date of this Act.
4343 SECTION 3. This Act takes effect September 1, 2015.
