55 AN ACT
66 relating to the regulation of commercial development of groundwater
77 in certain areas.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 35, Water Code, is amended by adding
1010 Section 35.021 to read as follows:
1111 Sec. 35.021. COMMERCIAL DEVELOPMENT OF GROUNDWATER IN
1212 CERTAIN ZONES. (a) In this section, "buffer zone" means an area
1313 that extends twelve miles from the boundaries of an aquifer
1414 encompassed by a groundwater conservation district that comprises
1515 of four counties, is located not greater than one hundred miles from
1616 the Gulf Coast, is located not greater than one hundred miles from
1717 the Texas-Mexico international border, and is adjacent to a county
1818 whose population is greater than 1.6 million.
1919 (b) Notwithstanding an exemption from permitting that might
2020 apply under the rules of a groundwater conservation district under
2121 Section 36.117, a person who seeks to drill or operate a well
2222 located in a buffer zone to produce groundwater for commercial
2323 purposes must submit an application for approval to drill and
2424 operate the well to the nearest geographically situated groundwater
2525 conservation district in which the aquifer is located.
2626 (c) The groundwater conservation district shall schedule,
2727 post notice for, and conduct a public hearing for comments before
2828 making a decision to approve or deny an application received under
2929 Subsection (b).
3030 (d) An application under this section must include the
3131 likely effects of the well's proposed production amounts over the
3232 25-year period that would begin on the expected date of first
3333 production from the well including:
3434 (1) potential adverse effects on the desired future
3535 condition adopted by a groundwater conservation district for the
3636 relevant aquifer under Section 36.108;
3737 (2) population growth predicted for the surrounding
3838 area;
3939 (3) shortages of surface water or groundwater
4040 resulting from a long-term drought;
4141 (4) potential land subsidence;
4242 (5) possible contamination of groundwater supplies;
4343 and
4444 (6) other issues groundwater conservation district
4545 considers relevant.
4646 (e) A well may be drilled and operated under this section
4747 only if the application is approved by the applicable groundwater
4848 conservation district, unless the well is exempt from permitting
4949 under the district's rules.
5050 SECTION 2. This Act applies only to a groundwater well for
5151 which the drilling is begun on or after the effective date of this
5252 Act. A well for which the drilling is begun before the effective
5353 date of this Act is governed by the law in effect on the date the
5454 drilling was begun, and that law is continued in effect for that
5555 purpose.
5656 SECTION 3. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2015.
