9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 2269.252(b), Government Code, is amended | |
11 | 11 | to read as follows: | |
12 | 12 | (b) The governmental entity's architect or engineer for a | |
13 | 13 | project may not serve, alone or in combination with another person, | |
14 | 14 | as the construction manager-at-risk unless the architect or | |
15 | 15 | engineer is hired to serve as the construction manager-at-risk | |
16 | 16 | under a separate, [or] concurrent, or single selection process | |
17 | 17 | conducted in accordance with this subchapter. This subsection does | |
18 | 18 | not prohibit the governmental entity's architect or engineer from | |
19 | 19 | providing customary construction phase services under the | |
20 | 20 | architect's or engineer's original professional service agreement | |
21 | 21 | in accordance with applicable licensing laws. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2015. |
