66 AN ACT
77 relating to the operation of autonomous motor vehicles by the Texas
88 Department of Transportation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 472, Transportation Code, is amended by
1111 adding Subchapter E to read as follows:
1212 SUBCHAPTER E. DEPARTMENT SAFETY AND EFFICIENCY PROGRAMS
1313 Sec. 472.041. DEPARTMENT USE OF AUTONOMOUS MOTOR VEHICLES.
1414 (a) In this section:
1515 (1) "Autonomous motor vehicle" means a self-propelled
1616 vehicle or piece of equipment that uses autonomous technology to
1717 operate itself without the active control or continuous monitoring
1818 of a person.
1919 (2) "Autonomous technology" means technology that
2020 enables a vehicle or piece of equipment to operate without the
2121 active control or continuous monitoring of a person. The term does
2222 not include, except to the extent that such a system may be a
2323 component of autonomous technology, an individual safety system or
2424 a driver assistance system that enhances safety or provides driver
2525 assistance but is not individually capable of operating a motor
2626 vehicle or piece of equipment without the active control or
2727 continuous monitoring of a person.
2828 (3) "Passenger vehicle" has the meaning assigned by
2929 Section 545.412.
3030 (b) An operator of an autonomous motor vehicle operating
3131 with autonomous technology is:
3232 (1) a person who causes the vehicle's autonomous
3333 technology to engage, regardless of whether the person is in the
3434 autonomous motor vehicle while the vehicle is operating; or
3535 (2) a person who is seated in the driver's seat of the
3636 autonomous motor vehicle and continuously monitors the operation of
3737 the autonomous motor vehicle.
3838 (c) The commission by order may authorize the department to
3939 operate an autonomous motor vehicle on the state highway system to
4040 perform construction and maintenance work for the department if:
4141 (1) the commission determines that the use of the
4242 autonomous motor vehicle will increase the efficiency of
4343 construction and maintenance projects and improve the safety of
4444 department employees and the public;
4545 (2) the manufacturer of that type of autonomous motor
4646 vehicle has certified that:
4747 (A) the autonomous technology of the autonomous
4848 motor vehicle:
4949 (i) complies with state and federal
5050 standards and regulations for motor vehicles; and
5151 (ii) does not impede the operation of a
5252 feature of a motor vehicle that is required for the motor vehicle to
5353 comply with:
5454 (a) state and federal standards and
5555 regulations for motor vehicles; or
5656 (b) federal motor vehicle safety
5757 standards for the model year of the motor vehicle, if the motor
5858 vehicle is a passenger vehicle;
5959 (B) the manufacturer has tested the autonomous
6060 motor vehicle on public roadways; and
6161 (C) the manufacturer has established financial
6262 responsibility in a manner accepted under Section 601.051 in an
6363 amount of at least $5 million;
6464 (3) the autonomous motor vehicle includes a fail-safe
6565 system where:
6666 (A) an indicator alerts the operator to a failure
6767 of the autonomous technology that may affect the motor vehicle's
6868 ability to operate autonomously; and
6969 (B) when the indicator is activated:
7070 (i) the motor vehicle may be manually
7171 controlled by the operator; or
7272 (ii) the motor vehicle stops;
7373 (4) the autonomous motor vehicle includes an indicator
7474 that indicates whether the vehicle's autonomous technology is
7575 turned on or off; and
7676 (5) the autonomous motor vehicle allows the operator
7777 to assume active control over the motor vehicle, including by using
7878 the brakes, accelerator pedal, and steering wheel.
7979 SECTION 2. This Act takes effect September 1, 2015.
