88 AN ACT
99 relating to the development of a statewide motor vehicle
1010 registration program to prevent transnational motor vehicle theft,
1111 including authorizing proposed fees to support the program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 411, Government Code, is
1414 amended by adding Section 411.0094 to read as follows:
1515 Sec. 411.0094. MOTOR VEHICLE REGISTRATION PROGRAM. (a)
1616 The department shall develop a statewide motor vehicle registration
1717 program to help prevent transnational motor vehicle theft. The
1818 department may not implement the program unless the legislature
1919 subsequently provides by general law for the implementation of the
2020 program.
2121 (b) Under the program, an owner of a motor vehicle may
2222 register the motor vehicle with the department to authorize a peace
2323 officer to stop the registered vehicle before the vehicle crosses
2424 the international border of this state.
2525 (c) The department shall develop a form to register a motor
2626 vehicle under the program. The form must advise the owner of the
2727 motor vehicle regarding the provisions of Subsection (f). A motor
2828 vehicle may not be registered under the program unless the owner
2929 consents to the provisions of Subsection (f).
3030 (d) The program must provide a method for an owner to
3131 withdraw a motor vehicle from the program. The program may not
3232 require an owner of a motor vehicle to participate in the program.
3333 (e) After implementation of the program, the department
3434 shall maintain a database of all motor vehicles registered under
3535 the program.
3636 (f) A peace officer who observes a motor vehicle that is
3737 registered under the program and is crossing the international
3838 border of this state may stop the motor vehicle to determine whether
3939 the motor vehicle is being operated by the owner or with the owner's
4040 permission.
4141 (g) The department shall propose rules to administer the
4242 program and may propose a registration fee in an amount sufficient
4343 to recover the cost of administering the program.
4444 SECTION 2. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2015.
