| 11 | 11 | | including authorizing proposed fees to support the program. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 411, Government Code, is |
|---|
| 14 | 14 | | amended by adding Section 411.0094 to read as follows: |
|---|
| 15 | 15 | | Sec. 411.0094. MOTOR VEHICLE REGISTRATION PROGRAM. (a) |
|---|
| 16 | 16 | | The department shall develop a statewide motor vehicle registration |
|---|
| 17 | 17 | | program to help prevent transnational motor vehicle theft. The |
|---|
| 18 | 18 | | department may not implement the program unless the legislature |
|---|
| 19 | 19 | | subsequently provides by general law for the implementation of the |
|---|
| 20 | 20 | | program. |
|---|
| 21 | 21 | | (b) Under the program, an owner of a motor vehicle may |
|---|
| 22 | 22 | | register the motor vehicle with the department to authorize a peace |
|---|
| 23 | 23 | | officer to stop the registered vehicle before the vehicle crosses |
|---|
| 24 | 24 | | the international border of this state. |
|---|
| 25 | 25 | | (c) The department shall develop a form to register a motor |
|---|
| 26 | 26 | | vehicle under the program. The form must advise the owner of the |
|---|
| 27 | 27 | | motor vehicle regarding the provisions of Subsection (f). A motor |
|---|
| 28 | 28 | | vehicle may not be registered under the program unless the owner |
|---|
| 29 | 29 | | consents to the provisions of Subsection (f). |
|---|
| 30 | 30 | | (d) The program must provide a method for an owner to |
|---|
| 31 | 31 | | withdraw a motor vehicle from the program. The program may not |
|---|
| 32 | 32 | | require an owner of a motor vehicle to participate in the program. |
|---|
| 33 | 33 | | (e) After implementation of the program, the department |
|---|
| 34 | 34 | | shall maintain a database of all motor vehicles registered under |
|---|
| 35 | 35 | | the program. |
|---|
| 36 | 36 | | (f) A peace officer who observes a motor vehicle that is |
|---|
| 37 | 37 | | registered under the program and is crossing the international |
|---|
| 38 | 38 | | border of this state may stop the motor vehicle to determine whether |
|---|
| 39 | 39 | | the motor vehicle is being operated by the owner or with the owner's |
|---|
| 40 | 40 | | permission. |
|---|
| 41 | 41 | | (g) The department shall propose rules to administer the |
|---|
| 42 | 42 | | program and may propose a registration fee in an amount sufficient |
|---|
| 43 | 43 | | to recover the cost of administering the program. |
|---|
| 44 | 44 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 48 | 48 | | Act takes effect September 1, 2015. |
