88 AN ACT
99 relating to the employment of persons under 18 years of age on the
1010 premises of certain businesses selling or serving alcoholic
1111 beverages; adding a provision that is subject to a criminal
1212 penalty.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 106.09, Alcoholic Beverage Code, is
1515 amended by amending Subsection (a) and adding Subsection (f) to
1616 read as follows:
1717 (a) Except as provided by [in] Subsections (b), (c), [and]
1818 (e), and (f) [of this section], no person may employ a person under
1919 18 years of age to sell, prepare, serve, or otherwise handle liquor,
2020 or to assist in doing so.
2121 (f) The holder of a permit or license providing for the
2222 on-premises consumption of alcoholic beverages that derives less
2323 than 50 percent of its gross receipts for the premises from the sale
2424 or service of alcoholic beverages may employ a person under 18 years
2525 of age to work as a cashier for transactions involving the sale of
2626 alcoholic beverages if the alcoholic beverages are served by a
2727 person 18 years of age or older.
2828 SECTION 2. The change in law made by this Act to Section
2929 106.09, Alcoholic Beverage Code, applies only to an offense
3030 committed on or after the effective date of this Act. An offense
3131 committed before the effective date of this Act is covered by the
3232 law in effect when the offense was committed, and the former law is
3333 continued in effect for that purpose. For purposes of this section,
3434 an offense was committed before the effective date of this Act if
3535 any element of the offense occurred before that date.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2015.
