11 | 11 | | beverages; adding a provision that is subject to a criminal |

13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 106.09, Alcoholic Beverage Code, is |
---|
15 | 15 | | amended by amending Subsection (a) and adding Subsection (f) to |
---|
16 | 16 | | read as follows: |
---|
17 | 17 | | (a) Except as provided by [in] Subsections (b), (c), [and] |
---|
18 | 18 | | (e), and (f) [of this section], no person may employ a person under |
---|
19 | 19 | | 18 years of age to sell, prepare, serve, or otherwise handle liquor, |
---|
20 | 20 | | or to assist in doing so. |
---|
21 | 21 | | (f) The holder of a permit or license providing for the |
---|
22 | 22 | | on-premises consumption of alcoholic beverages that derives less |
---|
23 | 23 | | than 50 percent of its gross receipts for the premises from the sale |
---|
24 | 24 | | or service of alcoholic beverages may employ a person under 18 years |
---|
25 | 25 | | of age to work as a cashier for transactions involving the sale of |
---|
26 | 26 | | alcoholic beverages if the alcoholic beverages are served by a |
---|
27 | 27 | | person 18 years of age or older. |

28 | 28 | | SECTION 2. The change in law made by this Act to Section |
---|
29 | 29 | | 106.09, Alcoholic Beverage Code, applies only to an offense |
---|
30 | 30 | | committed on or after the effective date of this Act. An offense |
---|
31 | 31 | | committed before the effective date of this Act is covered by the |
---|
32 | 32 | | law in effect when the offense was committed, and the former law is |
---|
33 | 33 | | continued in effect for that purpose. For purposes of this section, |
---|
34 | 34 | | an offense was committed before the effective date of this Act if |
---|
35 | 35 | | any element of the offense occurred before that date. |
---|
36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
---|
37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
40 | 40 | | Act takes effect September 1, 2015. |
