66 AN ACT
77 relating to an exemption from the sales tax for certain
88 water-conserving products for a limited period.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended
1111 by adding Section 151.3336 to read as follows:
1212 Sec. 151.3336. WATER-CONSERVING PRODUCTS. (a) In this
1313 section, "water-conserving product":
1414 (1) means tangible personal property that:
1515 (A) is used on private residential property and
1616 is not used for business or trade; and
1717 (B) when used or planted in an outdoor
1818 residential property, may result in:
1919 (i) water conservation or groundwater
2020 retention;
2121 (ii) water table recharge; or
2222 (iii) a decrease in ambient air temperature
2323 that limits water evaporation; and
2424 (2) includes:
2525 (A) a drought-tolerant live plant, including
2626 turf and grass;
2727 (B) a soaker or drip-irrigation hose;
2828 (C) a moisture control for a sprinkler or
2929 irrigation system;
3030 (D) mulch and soil;
3131 (E) a rain barrel or an alternative rain and
3232 moisture collection system;
3333 (F) a permeable ground cover surface that allows
3434 water to reach underground basins, aquifers, or water collection
3535 points;
3636 (G) plant and grass seeds coated with a
3737 water-saving surfactant; and
3838 (H) a water saving surfactant.
3939 (b) The sale of a water-conserving product is exempted from
4040 the taxes imposed by this chapter if the sale takes place during a
4141 period beginning at 12:01 a.m. on March 1 and ending at 11:59 p.m.
4242 on March 8.
4343 (c) The comptroller may adopt rules to implement this
4444 section.
4545 (d) The comptroller shall include in the report to the
4646 legislature required by Section 403.014, Government Code, a report
4747 on the effect of the exemption under this section. The report must
4848 include:
4949 (1) the amount by which taxes imposed under this
5050 chapter were reduced as a result of the exemption under this
5151 section; and
5252 (2) an analysis of the effect of the exemption on water
5353 conservation efforts in this state.
5454 SECTION 2. This Act takes effect September 1, 2015.
