99 relating to the issuance of certain permits for the movement of

1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subchapter P, Chapter 623,
1313 Transportation Code, is amended to read as follows:
1414 SUBCHAPTER P. PORT OF CORPUS CHRISTI AUTHORITY [SPECIAL FREIGHT
1515 CORRIDOR] PERMITS
1616 SECTION 2. Section 623.301, Transportation Code, is amended
1717 to read as follows:
1818 Sec. 623.301. OPTIONAL PROCEDURE. This subchapter provides
1919 an optional procedure for the issuance of a permit by the Port of
2020 Corpus Christi Authority for the movement of oversize or overweight
2121 vehicles carrying cargo on certain roads [a state highway special
2222 freight corridor] located in San Patricio and Nueces Counties
2323 [County].
2424 SECTION 3. Section 623.302, Transportation Code, is amended
2525 to read as follows:
2626 Sec. 623.302. DEFINITION [DEFINITIONS]. In this
2727 subchapter, "port [:
2828 [(1) "Port] authority" means the Port of Corpus
2929 Christi Authority[; and
3030 [(2) "Special freight corridor" means a highway built
3131 by this state specifically for the movement of oversize or
3232 overweight vehicles carrying cargo in San Patricio County to and
3333 from the port authority's La Quinta terminal].
3434 SECTION 4. Section 623.303, Transportation Code, is amended
3535 to read as follows:
3636 Sec. 623.303. ISSUANCE OF PERMITS. (a) The Texas
3737 Transportation Commission may authorize the port authority to issue
3838 permits for the movement of oversize or overweight vehicles
3939 carrying cargo [on state highway special freight corridors located]
4040 in San Patricio and Nueces Counties on:
4141 (1) the following roads:
4242 (A) U.S. Highway 181 between its intersection
4343 with Burleson Street in the city of Corpus Christi and its
4444 intersection with County Road 3567 (Midway Road) in San Patricio
4545 County;
4646 (B) State Highway 35 between its intersection
4747 with Burleson Street in the city of Corpus Christi and its
4848 intersection with Farm-to-Market Road 3512;
4949 (C) State Highway 361 between its intersection
5050 with State Highway 35 and its intersection with Farm-to-Market Road
5151 1069 (Main Street) in the city of Ingleside; and
5252 (D) proposed State Highway 200 between its
5353 intersection with State Highway 361 and its intersection with
5454 Farm-to-Market Road 1069 (Main Street) in the city of Ingleside, if
5555 proposed State Highway 200 is constructed; or
5656 (2) another route designated by the commission in
5757 consultation with the authority [County].
5858 (b) The port authority may issue a permit under this
5959 subchapter only if the cargo being transported weighs 125,000
6060 pounds or less.
6161 SECTION 5. Section 623.306(a), Transportation Code, is
6262 amended to read as follows:
6363 (a) A permit issued under this subchapter must include:
6464 (1) the name of the applicant;
6565 (2) the date of issuance;
6666 (3) the signature of the manager of transportation of
6767 the port authority;
6868 (4) a statement of the kind of cargo being
6969 transported, the maximum weight and dimensions of the equipment,
7070 and the kind and weight of each commodity to be transported;
7171 (5) a statement of any condition on which the permit is
7272 issued;
7373 (6) a statement that the cargo may [only] be
7474 transported in San Patricio and Nueces Counties only over the roads
7575 described by or designated under Section 623.303 [to and from the
7676 port authority's La Quinta terminal in San Patricio County using a
7777 state highway special freight corridor in San Patricio County]; and
7878 (7) the location where the cargo was loaded.
7979 SECTION 6. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2015.
