| 21 | 21 | | vehicles carrying cargo on certain roads [a state highway special |

| 22 | 22 | | freight corridor] located in San Patricio and Nueces Counties |

| 24 | 24 | | SECTION 3. Section 623.302, Transportation Code, is amended |
|---|
| 25 | 25 | | to read as follows: |
|---|
| 26 | 26 | | Sec. 623.302. DEFINITION [DEFINITIONS]. In this |
|---|
| 27 | 27 | | subchapter, "port [: |
|---|
| 28 | 28 | | [(1) "Port] authority" means the Port of Corpus |
|---|
| 29 | 29 | | Christi Authority[; and |
|---|
| 30 | 30 | | [(2) "Special freight corridor" means a highway built |

| 31 | 31 | | by this state specifically for the movement of oversize or |
|---|
| 32 | 32 | | overweight vehicles carrying cargo in San Patricio County to and |
|---|
| 33 | 33 | | from the port authority's La Quinta terminal]. |

| 34 | 34 | | SECTION 4. Section 623.303, Transportation Code, is amended |
|---|
| 35 | 35 | | to read as follows: |
|---|
| 36 | 36 | | Sec. 623.303. ISSUANCE OF PERMITS. (a) The Texas |
|---|
| 37 | 37 | | Transportation Commission may authorize the port authority to issue |
|---|
| 38 | 38 | | permits for the movement of oversize or overweight vehicles |
|---|
| 39 | 39 | | carrying cargo [on state highway special freight corridors located] |
|---|
| 40 | 40 | | in San Patricio and Nueces Counties on: |
|---|
| 41 | 41 | | (1) the following roads: |
|---|
| 42 | 42 | | (A) U.S. Highway 181 between its intersection |
|---|
| 43 | 43 | | with Burleson Street in the city of Corpus Christi and its |
|---|
| 44 | 44 | | intersection with County Road 3567 (Midway Road) in San Patricio |
|---|
| 45 | 45 | | County; |
|---|
| 46 | 46 | | (B) State Highway 35 between its intersection |
|---|
| 47 | 47 | | with Burleson Street in the city of Corpus Christi and its |
|---|
| 48 | 48 | | intersection with Farm-to-Market Road 3512; |
|---|
| 49 | 49 | | (C) State Highway 361 between its intersection |
|---|
| 50 | 50 | | with State Highway 35 and its intersection with Farm-to-Market Road |
|---|
| 51 | 51 | | 1069 (Main Street) in the city of Ingleside; and |

| 52 | 52 | | (D) proposed State Highway 200 between its |
|---|
| 53 | 53 | | intersection with State Highway 361 and its intersection with |
|---|
| 54 | 54 | | Farm-to-Market Road 1069 (Main Street) in the city of Ingleside, if |

| 55 | 55 | | proposed State Highway 200 is constructed; or |

| 56 | 56 | | (2) another route designated by the commission in |
|---|
| 57 | 57 | | consultation with the authority [County]. |

| 58 | 58 | | (b) The port authority may issue a permit under this |
|---|
| 59 | 59 | | subchapter only if the cargo being transported weighs 125,000 |
|---|
| 60 | 60 | | pounds or less. |
|---|
| 61 | 61 | | SECTION 5. Section 623.306(a), Transportation Code, is |
|---|
| 62 | 62 | | amended to read as follows: |
|---|
| 63 | 63 | | (a) A permit issued under this subchapter must include: |
|---|
| 64 | 64 | | (1) the name of the applicant; |
|---|
| 65 | 65 | | (2) the date of issuance; |
|---|
| 66 | 66 | | (3) the signature of the manager of transportation of |
|---|
| 67 | 67 | | the port authority; |
|---|
| 68 | 68 | | (4) a statement of the kind of cargo being |
|---|
| 69 | 69 | | transported, the maximum weight and dimensions of the equipment, |
|---|
| 70 | 70 | | and the kind and weight of each commodity to be transported; |
|---|
| 71 | 71 | | (5) a statement of any condition on which the permit is |
|---|
| 72 | 72 | | issued; |
|---|
| 73 | 73 | | (6) a statement that the cargo may [only] be |
|---|
| 74 | 74 | | transported in San Patricio and Nueces Counties only over the roads |
|---|
| 75 | 75 | | described by or designated under Section 623.303 [to and from the |
|---|
| 76 | 76 | | port authority's La Quinta terminal in San Patricio County using a |
|---|
| 77 | 77 | | state highway special freight corridor in San Patricio County]; and |
|---|
| 78 | 78 | | (7) the location where the cargo was loaded. |
|---|
| 79 | 79 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 80 | 80 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 81 | 81 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 82 | 82 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 83 | 83 | | Act takes effect September 1, 2015. |
