14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 9 | | SECTION 1. Section 124.001(a), Government Code, is amended |
---|
16 | 10 | | to read as follows: |
---|
17 | 11 | | (a) In this chapter, "veterans court program" means a |
---|
18 | 12 | | program that has the following essential characteristics: |
---|
19 | 13 | | (1) the integration of services in the processing of |
---|
20 | 14 | | cases in the judicial system; |
---|
21 | 15 | | (2) the use of a nonadversarial approach involving |
---|
22 | 16 | | prosecutors and defense attorneys to promote public safety and to |
---|
23 | 17 | | protect the due process rights of program participants; |
---|
24 | 18 | | (3) early identification and prompt placement of |
---|
25 | 19 | | eligible participants in the program; |
---|
26 | 20 | | (4) access to a continuum of alcohol, controlled |
---|
27 | 21 | | substance, mental health, and other related treatment and |
---|
28 | 22 | | rehabilitative services; |
---|
29 | 23 | | (5) careful monitoring of treatment and services |
---|
30 | 24 | | provided to program participants; |
---|
31 | 25 | | (6) a coordinated strategy to govern program responses |
---|
32 | 26 | | to participants' compliance; |
---|
33 | 27 | | (7) ongoing judicial interaction with program |
---|
34 | 28 | | participants; |
---|
35 | 29 | | (8) monitoring and evaluation of program goals and |
---|
36 | 30 | | effectiveness; |
---|
37 | 31 | | (9) continuing interdisciplinary education to promote |
---|
38 | 32 | | effective program planning, implementation, and operations; [and] |
---|
39 | 33 | | (10) development of partnerships with public agencies |
---|
40 | 34 | | and community organizations, including the United States |
---|
41 | 35 | | Department of Veterans Affairs; and |
---|
42 | 36 | | (11) inclusion of a participant's family members who |
---|
43 | 37 | | agree to be involved in the treatment and services provided to the |
---|
44 | 38 | | participant under the program. |
---|
45 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
---|
46 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
47 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
48 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
49 | 43 | | Act takes effect September 1, 2015. |
