21	4		AN ACT
22	5		relating to standards for elevators, escalators, and related
23	6		equipment; authorizing a fee.
24	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
25	8		SECTION 1. Section 754.014(a), Health and Safety Code, is
26	9		amended to read as follows:
27	10		(a) The commission by rule shall adopt standards for the
28	11		installation, maintenance, alteration, operation, testing, removal
29	12		from service, and inspection of equipment used by the public in:
30	13		(1) buildings owned or operated by the state, a
31	14		state-owned institution or agency, or a political subdivision of
32	15		the state; and
33	16		(2) buildings that contain equipment that is open to
34	17		the general public, including a hotel, motel, apartment house,
35	18		boardinghouse, church, office building, shopping center, or other
36	19		commercial establishment.
37	20		SECTION 2. Section 754.015(d), Health and Safety Code, is
38	21		amended to read as follows:
39	22		(d) The executive director may charge a reasonable fee as
40	23		set by the commission for:
41	24		(1) registering or renewing registration of an
42	25		elevator inspector;
43	26		(2) registering or renewing registration of a
44	27		contractor;
45	28		(3) applying for a certificate of compliance;
46	29		(4) filing an inspection report as required by Section
47	30		754.019(a)(3), 30 days or more after the date the report is due, for
48	31		each day the report remains not filed after the date the report is
49	32		due;
50	33		(5) submitting for review plans for the installation
51	34		or alteration of equipment;
52	35		(6) reviewing and approving continuing education
53	36		providers and courses for renewal of elevator inspector and
54	37		contractor registrations;
55	38		(7) applying for a waiver, new technology variance, or
56	39		delay; [and]
57	40		(8) attending a continuing education program
58	41		sponsored by the department for registered elevator inspectors; and
59	42		(9) applying to remove equipment from service.
60	43		SECTION 3. Section 754.019(a), Health and Safety Code, is
61	44		amended to read as follows:
62	45		(a) The owner shall:
63	46		(1) have the equipment inspected annually by a
64	47		registered elevator inspector, unless the equipment has been
65	48		removed from service in accordance with commission rules;
66	49		(2) obtain an inspection report from the inspector
67	50		evidencing that all equipment in a building on the real property was
68	51		inspected in accordance with this chapter and rules adopted under
69	52		this chapter;
70	53		(3) file with the executive director each inspection
71	54		report, and all applicable fees, not later than the 30th calendar
72	55		day after the date on which an inspection is made under this
73	56		chapter;
74	57		(4) display the certificate of compliance for the
75	58		equipment in a publicly visible area as defined by commission rule;
76	59		and
77	60		(5) maintain the equipment in compliance with the
78	61		standards and codes adopted under commission rules.
79	62		SECTION 4. As soon as practicable after the effective date
80	63		of this Act, the Texas Commission of Licensing and Regulation shall
81	64		adopt the rules necessary to implement the changes in law made by
82	65		this Act.
83	66		SECTION 5. This Act takes effect immediately if it receives
84	67		a vote of two-thirds of all the members elected to each house, as
85	68		provided by Section 39, Article III, Texas Constitution. If this
86	69		Act does not receive the vote necessary for immediate effect, this
87	70		Act takes effect September 1, 2015.
