| 7 | 7 | | relating to eliminating the set-aside of a portion of designated |

| 8 | 8 | | tuition for student financial assistance at public institutions of |

| 9 | 9 | | higher education. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 56, Education Code, is |
|---|
| 12 | 12 | | repealed. |
|---|
| 13 | 13 | | SECTION 2. Section 56.465(a), Education Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) The governing board of each institution of higher |
|---|
| 16 | 16 | | education shall cause to be set aside five percent of the amount of |
|---|
| 17 | 17 | | the tuition charged to a resident undergraduate student at the |
|---|
| 18 | 18 | | institution under Section 54.0513 in excess of $46 per semester |
|---|
| 19 | 19 | | credit hour. [The amount of a student's tuition set aside under |
|---|
| 20 | 20 | | this subsection is considered a part of the amount required to be |
|---|
| 21 | 21 | | set aside from that tuition under Section 56.011.] |
|---|
| 22 | 22 | | SECTION 3. (a) The repeal of Subchapter B, Chapter 56, |
|---|
| 23 | 23 | | Education Code, by this Act applies beginning with tuition charged |
|---|
| 24 | 24 | | for the 2015 fall semester. |
|---|
| 25 | 25 | | (b) The repeal of Subchapter B, Chapter 56, Education Code, |
|---|
| 26 | 26 | | by this Act does not affect the application of that subchapter to |
|---|
| 27 | 27 | | tuition set aside for purposes of that subchapter for any semester |
|---|
| 28 | 28 | | or other academic term before the 2015 fall semester, and the former |
|---|
| 29 | 29 | | law is continued in effect until the tuition set aside before the |
|---|
| 30 | 30 | | 2015 fall semester has been used as prescribed by that subchapter. |
|---|
| 31 | 31 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2015. |
