                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 8, 2015      TO: Honorable Garnet Coleman, Chair, House Committee on County Affairs      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB3752 by Lucio III (Relating to an appeal by certain law enforcement agency employees under county civil service to an independent third-party hearing examiner.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Local Government Code to authorize certain law enforcement agency employees in certain counties to appeal a disciplinary action to an independent third-party hearing examiner. The bill provides the process, selection, requirements of a hearing and fees regarding the third-party hearing examiner. The election to appeal to a hearing examiner, would constitute a waiver to the right to appeal to a district court, except that a court could hear an appeal of the hearing examiner's order on certain grounds.The Office of Court Administration reported no significant fiscal impact to the state court system is anticipated. Local Government Impact There could be costs associated with the provisions of the bill; however these costs would depend on the number of cases appealed to an independent third-party hearing examiner in a county.
