66 AN ACT
77 relating to administration of medication to residents of certain
88 assisted living and boarding home facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 247, Health and Safety
1111 Code, is amended by adding Section 247.0256 to read as follows:
1212 Sec. 247.0256. MEDICATION ADMINISTRATION ASSISTANCE. (a)
1313 Notwithstanding any other provision or rule, a resident who needs
1414 assistance with medication administration may authorize a family
1515 member or another person who is not an employee of the assisted
1616 living facility to:
1717 (1) administer the resident's medications; or
1818 (2) supervise or assist with the resident's medication
1919 administration.
2020 (b) An authorization under this section must be in writing
2121 and be signed by:
2222 (1) the resident;
2323 (2) the person assuming responsibility for:
2424 (A) administration of medication; or
2525 (B) supervision of or assistance with the
2626 administration of medication; and
2727 (3) a representative of the assisted living facility.
2828 (c) An assisted living facility that is party to an
2929 agreement under this section is not liable for any damages caused
3030 by:
3131 (1) improper administration of medication;
3232 (2) improper supervision of or assistance with
3333 administration of medication;
3434 (3) failure to administer medication; or
3535 (4) failure to supervise or assist with the
3636 administration of medication.
3737 (d) The agreement under this section may be terminated at
3838 any time by the resident communicating to the assisted living
3939 facility that the resident wishes to terminate the agreement. On
4040 termination of the agreement, the facility shall reassume any
4141 applicable duties with respect to the resident's medication.
4242 SECTION 2. Chapter 260, Health and Safety Code, is amended
4343 by adding Section 260.0031 to read as follows:
4444 Sec. 260.0031. MEDICATION ADMINISTRATION ASSISTANCE. (a)
4545 Notwithstanding any other provision or rule, a resident who needs
4646 assistance with self-administering medication may authorize a
4747 family member or another person who is not an employee of the
4848 boarding home facility to provide that assistance.
4949 (b) An authorization under this section must be in writing
5050 and be signed by:
5151 (1) the resident;
5252 (2) the person assuming responsibility for assistance
5353 with self-administering medication; and
5454 (3) a representative of the boarding home facility.
5555 (c) A boarding home facility that is party to an agreement
5656 under this section is not liable for any damages caused by:
5757 (1) improper assistance with self-administering
5858 medication; or
5959 (2) failure to provide assistance with
6060 self-administering medication.
6161 (d) The agreement under this section may be terminated at
6262 any time by the resident communicating to the boarding home
6363 facility that the resident wishes to terminate the agreement. On
6464 termination of the agreement, the facility shall reassume providing
6565 assistance with self-administering medication.
6666 SECTION 3. The executive commissioner of the Health and
6767 Human Services Commission may adopt forms for use in an agreement
6868 under Section 247.0256 or 260.0031, Health and Safety Code, as
6969 added by this Act.
7070 SECTION 4. This Act takes effect September 1, 2015.
