55 AN ACT
66 relating to the role of a jury in a criminal case.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Article 36.13, Code of Criminal Procedure, is
99 amended to read as follows:
1010 ART. 36.13. ROLE OF JURY [IS JUDGE OF FACTS]. Unless
1111 otherwise provided in this Code, the jury is the exclusive judge of
1212 the facts, but it is bound to receive the law from the court and be
1313 governed thereby. The court shall inform the jury of its role to
1414 judge the facts and to apply the law in relation to the facts in
1515 controversy.
1616 SECTION 2. The change in law made by this Act applies only
1717 to a
1818 jury selected on or after the effective date of this Act. A
1919 jury selected before the effective date of this Act is governed by
2020 the law in effect on the date the jury was selected, and the former
2121 law is continued in effect for that purpose.
2222 SECTION 3. This Act takes effect September 1, 2015.
