7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Article 36.13, Code of Criminal Procedure, is | |
9 | 9 | amended to read as follows: | |
10 | 10 | ART. 36.13. ROLE OF JURY [IS JUDGE OF FACTS]. Unless | |
11 | 11 | otherwise provided in this Code, the jury is the exclusive judge of | |
12 | 12 | the facts, but it is bound to receive the law from the court and be | |
13 | 13 | governed thereby. The court shall inform the jury of its role to | |
14 | 14 | judge the facts and to apply the law in relation to the facts in | |
15 | 15 | controversy. | |
16 | 16 | SECTION 2. The change in law made by this Act applies only | |
17 | 17 | to a | |
18 | 18 | jury selected on or after the effective date of this Act. A | |
19 | 19 | jury selected before the effective date of this Act is governed by | |
20 | 20 | the law in effect on the date the jury was selected, and the former | |
21 | 21 | law is continued in effect for that purpose. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2015. |
