66 AN ACT
77 relating to the prosecution of criminal offenses of electioneering
88 near a polling place.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.003(a), Election Code, is amended to
1111 read as follows:
1212 (a) A person commits an offense if, during the voting period
1313 [and within 100 feet of an outside door through which a voter may
1414 enter the building in which a polling place is located], the
1515 person[:
1616 [(1)] loiters[;] or
1717 [(2)] electioneers for or against any candidate,
1818 measure, or political party within 100 feet of:
1919 (1) an outside door through which a voter may enter the
2020 building in which a polling place is located; or
2121 (2) a parking space for persons with disabilities that
2222 serves the building and a designated travel path between the space
2323 and an outside door of the building.
2424 SECTION 2. Section 85.036(a), Election Code, is amended to
2525 read as follows:
2626 (a) During the time an early voting polling place is open
2727 for the conduct of early voting, a person may not electioneer for or
2828 against any candidate, measure, or political party in or within 100
2929 feet of:
3030 (1) an outside door through which a voter may enter the
3131 building or structure in which the early voting polling place is
3232 located; or
3333 (2) a parking space for persons with disabilities that
3434 serves the building or structure and a designated travel path
3535 between the space and an outside door of the building or structure.
3636 SECTION 3. This Act takes effect September 1, 2015.
