10 | 10 | | the voter registrar of a death and related procedures. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 16.031, Election Code, is amended by |
---|
13 | 13 | | amending Subsection (b) and adding Subsection (c) to read as |
---|
14 | 14 | | follows: |
---|
15 | 15 | | (b) The registrar shall cancel a voter's registration |
---|
16 | 16 | | immediately if the registrar: |
---|
17 | 17 | | (1) determines from information received under |
---|
18 | 18 | | Section 16.001(c) that the voter is deceased; |
---|
19 | 19 | | (2) has personal knowledge that the voter is deceased; |
---|
20 | 20 | | (3) receives from a person related within the second |
---|
21 | 21 | | degree by consanguinity or affinity, as determined under Chapter |
---|
22 | 22 | | 573, Government Code, to the voter a signed [sworn] statement by |
---|
23 | 23 | | that person indicating that the voter is deceased; or |
---|
24 | 24 | | (4) receives notice from the secretary of state under |
---|
25 | 25 | | Section 18.068 that the voter is deceased. |
---|
26 | 26 | | (c) The secretary of state shall prescribe and make publicly |
---|
27 | 27 | | available a form that a person may use to make a statement under |
---|
28 | 28 | | Subsection (b)(3). The form must: |
---|
29 | 29 | | (1) state that the person submitting the form must be |
---|
30 | 30 | | related to the deceased person within the second degree by |
---|
31 | 31 | | consanguinity or affinity, as determined under Chapter 573, |
---|
32 | 32 | | Government Code; |
---|
33 | 33 | | (2) require the person submitting the form to sign the |
---|
34 | 34 | | form; and |
---|
35 | 35 | | (3) require the person to provide enough information |
---|
36 | 36 | | to enable the voter registrar to distinguish the deceased person |
---|
37 | 37 | | from any other registered voter. |
---|
38 | 38 | | SECTION 2. Section 651.201(a), Occupations Code, is amended |
---|
39 | 39 | | to read as follows: |
---|
40 | 40 | | (a) The commission shall prepare a brochure with |
---|
41 | 41 | | information of public interest: |
---|
42 | 42 | | (1) explaining matters relating to funerals; [and] |
---|
43 | 43 | | (2) describing: |
---|
44 | 44 | | (A) the functions of the commission; and |
---|
45 | 45 | | (B) the commission's procedures for filing and |
---|
46 | 46 | | resolving a public complaint; and |
---|
47 | 47 | | (3) informing persons that a voter registrar must |
---|
48 | 48 | | cancel a voter's voter registration if a person related to the voter |
---|
49 | 49 | | within the second degree by consanguinity or affinity, as |
---|
50 | 50 | | determined under Chapter 573, Government Code, provides the |
---|
51 | 51 | | registrar with a signed statement by the person indicating that the |
---|
52 | 52 | | voter is deceased, and that the secretary of state has adopted a |
---|
53 | 53 | | form that may be used to make the signed statement. |
---|
54 | 54 | | SECTION 3. This Act takes effect January 1, 2016. |
