88 AN ACT
99 relating to providing certain persons with resources for notifying
1010 the voter registrar of a death and related procedures.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 16.031, Election Code, is amended by
1313 amending Subsection (b) and adding Subsection (c) to read as
1414 follows:
1515 (b) The registrar shall cancel a voter's registration
1616 immediately if the registrar:
1717 (1) determines from information received under
1818 Section 16.001(c) that the voter is deceased;
1919 (2) has personal knowledge that the voter is deceased;
2020 (3) receives from a person related within the second
2121 degree by consanguinity or affinity, as determined under Chapter
2222 573, Government Code, to the voter a signed [sworn] statement by
2323 that person indicating that the voter is deceased; or
2424 (4) receives notice from the secretary of state under
2525 Section 18.068 that the voter is deceased.
2626 (c) The secretary of state shall prescribe and make publicly
2727 available a form that a person may use to make a statement under
2828 Subsection (b)(3). The form must:
2929 (1) state that the person submitting the form must be
3030 related to the deceased person within the second degree by
3131 consanguinity or affinity, as determined under Chapter 573,
3232 Government Code;
3333 (2) require the person submitting the form to sign the
3434 form; and
3535 (3) require the person to provide enough information
3636 to enable the voter registrar to distinguish the deceased person
3737 from any other registered voter.
3838 SECTION 2. Section 651.201(a), Occupations Code, is amended
3939 to read as follows:
4040 (a) The commission shall prepare a brochure with
4141 information of public interest:
4242 (1) explaining matters relating to funerals; [and]
4343 (2) describing:
4444 (A) the functions of the commission; and
4545 (B) the commission's procedures for filing and
4646 resolving a public complaint; and
4747 (3) informing persons that a voter registrar must
4848 cancel a voter's voter registration if a person related to the voter
4949 within the second degree by consanguinity or affinity, as
5050 determined under Chapter 573, Government Code, provides the
5151 registrar with a signed statement by the person indicating that the
5252 voter is deceased, and that the secretary of state has adopted a
5353 form that may be used to make the signed statement.
5454 SECTION 3. This Act takes effect January 1, 2016.
