| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 471.007(a), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) A railway company commits an offense if: | |
| 13 | 13 | (1) a train of the railway company obstructs for more | |
| 14 | 14 | than 10 minutes a street, railroad crossing, or public highway; and | |
| 15 | 15 | (2) as a result, an authorized emergency vehicle, as | |
| 16 | 16 | defined by Section 541.201, is prevented from taking the most | |
| 17 | 17 | direct route to an emergency. | |
| 18 | 18 | SECTION 2. (a) The change in law made by this Act applies | |
| 19 | 19 | only to an offense committed on or after the effective date of this | |
| 20 | 20 | Act. For purposes of this section, an offense is committed before | |
| 21 | 21 | the effective date of this Act if any element of the offense occurs | |
| 22 | 22 | before that date. | |
| 23 | 23 | (b) An offense committed before the effective date of this | |
| 24 | 24 | Act is covered by the law in effect when the offense was committed, | |
| 25 | 25 | and the former law is continued in effect for that purpose. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2015. |
