55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the criminal offense of obstructing
88 a street, railroad crossing, or public highway.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 471.007(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) A railway company commits an offense if:
1313 (1) a train of the railway company obstructs for more
1414 than 10 minutes a street, railroad crossing, or public highway; and
1515 (2) as a result, an authorized emergency vehicle, as
1616 defined by Section 541.201, is prevented from taking the most
1717 direct route to an emergency.
1818 SECTION 2. (a) The change in law made by this Act applies
1919 only to an offense committed on or after the effective date of this
2020 Act. For purposes of this section, an offense is committed before
2121 the effective date of this Act if any element of the offense occurs
2222 before that date.
2323 (b) An offense committed before the effective date of this
2424 Act is covered by the law in effect when the offense was committed,
2525 and the former law is continued in effect for that purpose.
2626 SECTION 3. This Act takes effect September 1, 2015.
