| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Chapter 2, Code of Criminal Procedure, is |
|---|
| 15 | 9 | | amended by adding Article 2.139 to read as follows: |
|---|
| 16 | 10 | | Art. 2.139. VIDEO RECORDINGS OF ARRESTS FOR INTOXICATION |
|---|
| 17 | 11 | | OFFENSES. A person stopped or arrested on suspicion of an offense |
|---|
| 18 | 12 | | under Section 49.04, 49.045, 49.07, or 49.08, Penal Code, is |
|---|
| 19 | 13 | | entitled to receive from a law enforcement agency employing the |
|---|
| 20 | 14 | | peace officer who made the stop or arrest a copy of any video made by |
|---|
| 21 | 15 | | or at the direction of the officer that contains footage of: |
|---|
| 22 | 16 | | (1) the stop; |
|---|
| 23 | 17 | | (2) the arrest; |
|---|
| 24 | 18 | | (3) the conduct of the person stopped during any |
|---|
| 25 | 19 | | interaction with the officer, including during the administration |
|---|
| 26 | 20 | | of a field sobriety test; or |
|---|
| 27 | 21 | | (4) a procedure in which a specimen of the person's |
|---|
| 28 | 22 | | breath or blood is taken. |

| 29 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 24 | | to a recording of conduct that occurs on or after the effective date |
|---|
| 31 | 25 | | of this Act. |

| 32 | 26 | | SECTION 3. This Act takes effect September 1, 2015. |
