104 AN ACT
115 relating to the provision of recordings of certain interactions
126 with a peace officer relating to intoxication offenses.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Chapter 2, Code of Criminal Procedure, is
159 amended by adding Article 2.139 to read as follows:
1610 Art. 2.139. VIDEO RECORDINGS OF ARRESTS FOR INTOXICATION
1711 OFFENSES. A person stopped or arrested on suspicion of an offense
1812 under Section 49.04, 49.045, 49.07, or 49.08, Penal Code, is
1913 entitled to receive from a law enforcement agency employing the
2014 peace officer who made the stop or arrest a copy of any video made by
2115 or at the direction of the officer that contains footage of:
2216 (1) the stop;
2317 (2) the arrest;
2418 (3) the conduct of the person stopped during any
2519 interaction with the officer, including during the administration
2620 of a field sobriety test; or
2721 (4) a procedure in which a specimen of the person's
2822 breath or blood is taken.
2923 SECTION 2. The change in law made by this Act applies only
3024 to a recording of conduct that occurs on or after the effective date
3125 of this Act.
3226 SECTION 3. This Act takes effect September 1, 2015.
