55 AN ACT
66 relating to entities providing engineering services to a utility or
77 affiliate.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1001.002, Occupations Code, is amended
1010 by adding Subdivision (3) to read as follows:
1111 (3) "Telephony" means the construction, deployment,
1212 maintenance or operation of telephones and telephonic systems or
1313 telecommunications in which telephonic equipment with or without
1414 the use of wires is employed. It includes all design, construction,
1515 excavation, trench safety, traffic planning or maintenance
1616 necessary to design, deploy or maintain such systems in
1717 rights-of-way, utility easements or private property, but does not
1818 include constructing or placing a full-size manhole or connecting
1919 structures between full-size manholes.
2020 SECTION 2. Section 1001.058, Occupations Code, is amended
2121 by amending Subdivision (a) to read as follows:
2222 (a) A regular full-time employee of a privately owned public
2323 utility or cooperative utility or of the utility's affiliate,
2424 including any agents or engineering firms performing work on behalf
2525 of and under the supervision of such utility or affiliate, is exempt
2626 from the licensing requirements of this chapter if the employee:
2727 (1) performs services exclusively for the utility or
2828 affiliate; and
2929 (2) does not have the final authority to approve, or
3030 the ultimate responsibility for, engineering designs, plans, or
3131 specifications that are to be:
3232 (A) incorporated into fixed works, systems, or
3333 facilities on the property of others; or
3434 (B) made available to the public.
3535 SECTION 3. EFFECTIVE DATE. This Act takes effect
3636 immediately if it receives a vote of two-thirds of all the members
3737 elected to each house, as provided by Section 39, Article III, Texas
3838 Constitution. If this Act does not receive the vote necessary for
3939 immediate effect, this Act takes effect September 1, 2015.
