99 relating to financial assistance to local governmental entities
1010 affected by the realignment of defense jobs or facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 436.1531(a), Government Code, is amended
1313 to read as follows:
1414 (a) The office may provide a loan of financial assistance to
1515 a defense community for an economic development project that
1616 minimizes the negative effects of a defense base reduction on the
1717 defense community as a result of a United States Department of
1818 Defense base realignment process that occurs during 1995 [2005] or
1919 later. The loan shall be made from the Texas military value
2020 revolving loan account established under Section 436.156.
2121 SECTION 2. Section 436.1532(a), Government Code, is amended
2222 to read as follows:
2323 (a) The office may provide a loan of financial assistance to
2424 a defense community for an infrastructure project to accommodate
2525 new or expanded military missions assigned to a military base or
2626 defense facility located in, near, or adjacent to the defense
2727 community as a result of a United States Department of Defense base
2828 realignment process that occurs during 1995 [2005] or later. The
2929 loan shall be made from the Texas military value revolving loan
3030 account established under Section 436.156.
3131 SECTION 3. Sections 436.202(a) and (b), Government Code,
3232 are amended to read as follows:
3333 (a) From money appropriated for this purpose, the
3434 commission may make a grant to an eligible local governmental
3535 entity to:
3636 (1) enable the entity to match money or meet an
3737 investment requirement necessary to receive federal assistance
3838 provided to the local governmental entity for responding to or
3939 recovering from an event described by Section 436.201(b);
4040 (2) match the entity's contribution for a purpose
4141 described by Section 436.203 at a closed or realigned defense
4242 facility; [or]
4343 (3) construct infrastructure and other projects
4444 necessary to accommodate a new or expanded military mission at a
4545 military base or to reduce the impact of an action of the United
4646 States Department of Defense that will negatively impact a defense
4747 facility located in or near the entity; or
4848 (4) construct infrastructure and other projects
4949 necessary to prevent the reduction or closing of a defense
5050 facility.
5151 (b) The commission may not make a grant for an amount less
5252 than $50,000 or an amount more than the lesser of:
5353 (1) 50 percent of the amount of matching money or
5454 investment that the local governmental entity is required to
5555 provide, subject to Subsection (c);
5656 (2) 50 percent of the local governmental entity's
5757 investment for purposes described by Section 436.203 if federal
5858 assistance is unavailable; or
5959 (3) $5 [$2] million.
6060 SECTION 4. Section 436.203(c), Government Code, is amended
6161 to read as follows:
6262 (c) An eligible local governmental entity described by
6363 Section 436.201(a)(3), [or] (4), or (5) may use the proceeds of the
6464 grant to purchase or lease equipment to train defense workers whose
6565 jobs have been threatened or lost because of an event described by
6666 Section 436.201(b) or to train workers to support military
6767 installations or defense facilities.
6868 SECTION 5. This Act takes effect immediately if it receives
6969 a vote of two-thirds of all the members elected to each house, as
7070 provided by Section 39, Article III, Texas Constitution. If this
7171 Act does not receive the vote necessary for immediate effect, this
7272 Act takes effect September 1, 2015.
