44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the creation of the criminal offense of barratry by a
77 public insurance adjuster.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 38.12(d), Penal Code, is amended to read
1010 as follows:
1111 (d) A person commits an offense if the person:
1212 (1) is an attorney, chiropractor, physician, surgeon,
1313 public insurance adjuster, as defined by Section 4102.001,
1414 Insurance Code, or private investigator licensed to practice in
1515 this state or any person licensed, certified, or registered by a
1616 health care regulatory agency of this state; and
1717 (2) with the intent to obtain professional employment
1818 for the person or for another, provides or knowingly permits to be
1919 provided to an individual who has not sought the person's
2020 employment, legal representation, advice, or care a written
2121 communication or a solicitation, including a solicitation in person
2222 or by telephone, that:
2323 (A) concerns an action for personal injury or
2424 wrongful death or otherwise relates to an accident or disaster
2525 involving the person to whom the communication or solicitation is
2626 provided or a relative of that person and that was provided before
2727 the 31st day after the date on which the accident or disaster
2828 occurred;
2929 (B) concerns a specific matter and relates to
3030 legal representation and the person knows or reasonably should know
3131 that the person to whom the communication or solicitation is
3232 directed is represented by a lawyer in the matter;
3333 (C) concerns a lawsuit of any kind, including an
3434 action for divorce, in which the person to whom the communication or
3535 solicitation is provided is a defendant or a relative of that
3636 person, unless the lawsuit in which the person is named as a
3737 defendant has been on file for more than 31 days before the date on
3838 which the communication or solicitation was provided;
3939 (D) is provided or permitted to be provided by a
4040 person who knows or reasonably should know that the injured person
4141 or relative of the injured person has indicated a desire not to be
4242 contacted by or receive communications or solicitations concerning
4343 employment;
4444 (E) involves coercion, duress, fraud,
4545 overreaching, harassment, intimidation, or undue influence; [or]
4646 (F) contains a false, fraudulent, misleading,
4747 deceptive, or unfair statement or claim; or
4848 (G) concerns a property damage insurance claim
4949 and any such communication is made by a licensed public insurance
5050 adjuster for any purpose other than:
5151 (i) directly rendering the services of a
5252 public insurance adjuster consistent with Section 4102.001,
5353 Insurance Code; or
5454 (ii) directly rendering the services of a
5555 public insurance adjuster consistent with Section 4102.001,
5656 Insurance Code, by another licensed public insurance adjuster
5757 within the same business entity licensed under Sec. 4102.055,
5858 Insurance Code.
5959 SECTION 2. The changes in law made by this Act apply only to
6060 an offense committed on or after the effective date of this Act. An
6161 offense committed before the effective date of this Act is governed
6262 by the law in effect when the offense was committed, and the former
6363 law is continued in effect for that purpose.
6464 For purposes of this
6565 section, an offense was committed before the effective date of this
6666 Act if any element of the offense occurred before that date.
6767 SECTION 3. This Act takes effect September 1, 2015.
