76 AN ACT
87 relating to authorization by the Texas Higher Education
98 Coordinating Board for certain public junior colleges to offer
109 early childhood education baccalaureate degree programs.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Section 130.0012, Education Code, is amended by
1312 adding Subsections (b-1), (b-2), and (g-1) and amending Subsection
1413 (g) to read as follows:
1514 (b-1) The coordinating board shall authorize a
1615 baccalaureate degree program in early childhood education at each
17- public junior college located in a county with a population of
18- greater than one million if:
19- (1) the county has a demonstrated initial need for at
20- least 3,000 early childhood educators;
16+ public junior college located in a county with a population of 2.2
17+ million or more and adjacent to a county with a population of more
18+ than 600,000 if:
19+ (1) the county in which the public junior college is
20+ located has a demonstrated initial need for at least 3,000 early
21+ childhood educators;
2122 (2) the degree program curriculum is approved by the
2223 independent school districts located in the county that
2324 collectively represent at least 51 percent of the student
2425 population enrolled in kindergarten through 12th grade; and
2526 (3) one of the following:
2627 (A) before November 1, 2015, a regional public
27- university located in the county or an immediately adjacent county
28- is unable to obtain the approval of the independent school
29- districts located in the county that collectively represent at
30- least 51 percent of the student population enrolled in kindergarten
31- through 12th grade for a detailed plan to:
28+ university located in the county in which the public junior college
29+ is located or an immediately adjacent county is unable to obtain the
30+ approval of the independent school districts located in the county
31+ in which the public junior college is located that collectively
32+ represent at least 51 percent of the student population enrolled in
33+ kindergarten through 12th grade for a detailed plan to:
3234 (i) expand degree output of early childhood
3335 and elementary certified teachers to collectively meet the
3436 three-year average hiring demands of the independent school
35- districts located in the county and immediately adjacent counties,
36- including producing more prekindergarten teachers to support the
37- planned increases in prekindergarten enrollment for all public
38- schools;
37+ districts located in the county in which the public junior college
38+ is located and immediately adjacent counties, including producing
39+ more prekindergarten teachers to support the planned increases in
40+ prekindergarten enrollment for all public schools;
3941 (ii) implement an early childhood education
4042 curriculum; and
4143 (iii) fund the expansion of current or
4244 development of new early childhood education programs, which does
4345 not include state funding for new facilities; or
4446 (B) before September 1, 2017, a regional public
4547 university that received the approval of independent school
4648 districts as described by Paragraph (A) is unable to demonstrate:
4749 (i) the necessary current student
4850 enrollment to produce sufficient early childhood and elementary
4951 certified teachers within the next four years to meet the existing
5052 hiring demands of the independent school districts located in the
51- county and immediately adjacent counties based on historical
52- three-year averages, including producing more prekindergarten
53- teachers to support the planned increases in prekindergarten
54- enrollment for all public schools; and
53+ county in which the public junior college is located and
54+ immediately adjacent counties based on historical three-year
55+ averages, including producing more prekindergarten teachers to
56+ support the planned increases in prekindergarten enrollment for all
57+ public schools; and
5558 (ii) implementation of an early childhood
5659 education curriculum meeting the expressed needs of the independent
57- school districts located in the county that collectively represent
58- at least 51 percent of the student population enrolled in
59- kindergarten through 12th grade.
60+ school districts located in the county in which the public junior
61+ college is located that collectively represent at least 51 percent
62+ of the student population enrolled in kindergarten through 12th
63+ grade.
6064 (b-2) The coordinating board may not subsequently terminate
6165 authorization to offer an early childhood baccalaureate degree
6266 program granted under Subsection (b-1) on the ground that
6367 implementation of the degree program reduces the workforce need to
6468 a level that is below the minimal threshold specified in Subsection
6569 (b-1)(1).
6670 (g) Except as provided by Subsection (g-1), in [In] its
6771 recommendations to the legislature relating to state funding for
6872 public junior colleges, the coordinating board shall recommend that
6973 a public junior college receive substantially the same state
7074 support for junior-level and senior-level courses offered under
7175 this section as that provided to a general academic teaching
7276 institution for substantially similar courses. In determining the
7377 contact hours attributable to students enrolled in a junior-level
7478 or senior-level course offered under this section used to determine
7579 a public junior college's proportionate share of state
7680 appropriations under Section 130.003, the coordinating board shall
7781 weigh those contact hours as necessary to provide the junior
7882 college the appropriate level of state support to the extent state
79- funds for those courses are included in the appropriations. This
83+ funds for those courses are included in the appropriations.
84+ This
8085 subsection does not prohibit the legislature from directly
8186 appropriating state funds to support junior-level and senior-level
8287 courses offered under this section.
8388 (g-1) A degree program created under Subsection (b-1) may be
8489 funded only by a public junior college's proportionate share of
8590 state appropriations under Section 130.003, local funds, and
8691 private sources. This subsection does not require the legislature
8792 to appropriate state funds to support a degree program created
8893 under Subsection (b-1).
8994 SECTION 2. This Act takes effect September 1, 2015.
