99 relating to the licensing and regulation of certain rainwater
1010 harvesting; providing administrative penalties; authorizing fees;
1111 requiring an occupational license.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Title 7, Agriculture Code, is amended by adding
1414 Chapter 202 to read as follows:
1515 CHAPTER 202. RAINWATER HARVESTING
1616 SUBCHAPTER A. POWERS AND DUTIES OF DEPARTMENT
1717 Sec. 202.001. RULES. The department shall adopt rules that
1818 are reasonable and necessary for the performance of the
1919 department's duties under this chapter, including rules to
2020 establish:
2121 (1) licensing and other fees;
2222 (2) license renewal dates;
2323 (3) procedures for disciplinary actions; and
2424 (4) standards for the installation and maintenance of
2525 rainwater harvesting equipment by a license holder.
2626 Sec. 202.002. LICENSING AND REGULATORY DUTIES. The
2727 department shall:
2828 (1) review and approve or reject each application for
2929 the issuance or renewal of a license;
3030 (2) issue each license; and
3131 (3) deny, suspend, or revoke a license or otherwise
3232 discipline a license holder.
3333 SUBCHAPTER B. RAINWATER HARVESTING LICENSE
3434 Sec. 202.051. LICENSE REQUIRED. A person may not install or
3535 maintain or offer to install or maintain, for compensation, a
3636 rainwater harvesting system with a capacity of more than 500
3737 gallons unless the person holds:
3838 (1) a license under this chapter; or
3939 (2) a master plumber or a journeyman plumber license
4040 issued by the Texas State Board of Plumbing Examiners and holds a
4141 water supply protection specialist endorsement issued by the board.
4242 Sec. 202.052. ISSUANCE OF LICENSE. The department shall
4343 issue a license to an applicant who:
4444 (1) meets the eligibility requirements of Section
4545 202.053;
4646 (2) submits an application on a form prescribed by the
4747 department; and
4848 (3) pays the required application fee.
4949 Sec. 202.053. ELIGIBILITY REQUIREMENTS. To be eligible for
5050 a license under this chapter, an applicant must:
5151 (1) successfully complete a rainwater harvesting
5252 training program approved by the department; and
5353 (2) pass an examination administered or approved by
5454 the department.
5555 Sec. 202.054. LICENSE TERM AND RENEWAL. (a) A license
5656 issued under this chapter is valid for three years.
5757 (b) A person who holds a license under this chapter may
5858 renew the license by:
5959 (1) paying the required renewal fee;
6060 (2) submitting the appropriate form; and
6161 (3) meeting any other requirement established by
6262 department rule.
6363 Sec. 202.055. CONTINUING EDUCATION REQUIREMENTS. The
6464 department by rule shall adopt, monitor, and enforce a reporting
6565 program for the continuing education of license holders. The
6666 department shall adopt and administer rules that:
6767 (1) establish the number of hours of continuing
6868 education the department determines appropriate as a prerequisite
6969 to the renewal of a license under this chapter; and
7070 (2) adopt a process to assess a license holder's
7171 participation in continuing education courses.
7272 SUBCHAPTER C. PENALTIES AND ENFORCEMENT PROVISIONS
7373 Sec. 202.101. LICENSE SUSPENSION OR REVOCATION. The
7474 department may suspend or revoke a license if the license holder
7575 violates this chapter or a rule adopted under this chapter.
7676 Sec. 202.102. ADMINISTRATIVE PENALTY. A person who
7777 violates this chapter or a rule or order adopted by the department
7878 under this chapter is subject to an administrative penalty under
7979 Section 12.020, regardless of whether the person holds a license
8080 under this chapter.
8181 SECTION 2. Section 12.020(c), Agriculture Code, is amended
8282 to read as follows:

105105 SECTION 3. Not later than March 1, 2016, the Department of

109109 section, this Act takes effect September 1, 2015.
