88 AN ACT
99 relating to the confidentiality of certain information regarding
1010 procedures and substances used in the execution of a convict.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1313 amended by adding Section 552.1081 to read as follows:
1414 Sec. 552.1081. EXCEPTION: CONFIDENTIALITY OF CERTAIN
1515 INFORMATION REGARDING EXECUTION OF CONVICT. Information is
1616 excepted from the requirements of Section 552.021 if it contains
1717 identifying information under Article 43.14, Code of Criminal
1818 Procedure, including that of:
1919 (1) any person who participates in an execution
2020 procedure, including a person who uses, supplies, or administers a
2121 substance during the execution; and
2222 (2) any person or entity that manufactures,
2323 transports, tests, procures, compounds, prescribes, dispenses, or
2424 provides a substance or supplies used in an execution.
2525 SECTION 2. Article 43.14, Code of Criminal Procedure, is
2626 amended to read as follows:
2727 Art. 43.14. EXECUTION OF CONVICT: CONFIDENTIAL INFORMATION
2828 [CONVICT]. (a) Whenever the sentence of death is pronounced
2929 against a convict, the sentence shall be executed at any time after
3030 the hour of 6 p.m. on the day set for the execution, by intravenous
3131 injection of a substance or substances in a lethal quantity
3232 sufficient to cause death and until such convict is dead, such
3333 execution procedure to be determined and supervised by the director
3434 of the correctional institutions division of the Texas Department
3535 of Criminal Justice.
3636 (b) The name, address, and other identifying information of
3737 the following is confidential and excepted from disclosure under
3838 Section 552.021, Government Code:
3939 (1) any person who participates in an execution
4040 procedure described by Subsection (a), including a person who uses,
4141 supplies, or administers a substance during the execution; and
4242 (2) any person or entity that manufactures,
4343 transports, tests, procures, compounds, prescribes, dispenses, or
4444 provides a substance or supplies used in an execution.
4545 SECTION 3. The changes in law made by this Act apply only to
4646 a request for information that is received by a governmental body or
4747 an officer for public information on or after the effective date of
4848 this Act. A request for information that was received before the
4949 effective date of this Act is governed by the law in effect on the
5050 date the request was received, and the former law is continued in
5151 effect for that purpose.
5252 SECTION 4. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2015.
