10 | 10 | | procedures and substances used in the execution of a convict. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter C, Chapter 552, Government Code, is |
---|
13 | 13 | | amended by adding Section 552.1081 to read as follows: |
---|
14 | 14 | | Sec. 552.1081. EXCEPTION: CONFIDENTIALITY OF CERTAIN |
---|
15 | 15 | | INFORMATION REGARDING EXECUTION OF CONVICT. Information is |
---|
16 | 16 | | excepted from the requirements of Section 552.021 if it contains |
---|
17 | 17 | | identifying information under Article 43.14, Code of Criminal |
---|
18 | 18 | | Procedure, including that of: |
---|
19 | 19 | | (1) any person who participates in an execution |
---|
20 | 20 | | procedure, including a person who uses, supplies, or administers a |
---|
21 | 21 | | substance during the execution; and |
---|
22 | 22 | | (2) any person or entity that manufactures, |
---|
23 | 23 | | transports, tests, procures, compounds, prescribes, dispenses, or |
---|
24 | 24 | | provides a substance or supplies used in an execution. |
---|
25 | 25 | | SECTION 2. Article 43.14, Code of Criminal Procedure, is |
---|
26 | 26 | | amended to read as follows: |
---|
27 | 27 | | Art. 43.14. EXECUTION OF CONVICT: CONFIDENTIAL INFORMATION |
---|
28 | 28 | | [CONVICT]. (a) Whenever the sentence of death is pronounced |
---|
29 | 29 | | against a convict, the sentence shall be executed at any time after |
---|
30 | 30 | | the hour of 6 p.m. on the day set for the execution, by intravenous |
---|
31 | 31 | | injection of a substance or substances in a lethal quantity |
---|
32 | 32 | | sufficient to cause death and until such convict is dead, such |
---|
33 | 33 | | execution procedure to be determined and supervised by the director |
---|
34 | 34 | | of the correctional institutions division of the Texas Department |
---|
35 | 35 | | of Criminal Justice. |
---|
36 | 36 | | (b) The name, address, and other identifying information of |
---|
37 | 37 | | the following is confidential and excepted from disclosure under |
---|
38 | 38 | | Section 552.021, Government Code: |
---|
39 | 39 | | (1) any person who participates in an execution |
---|
40 | 40 | | procedure described by Subsection (a), including a person who uses, |
---|
41 | 41 | | supplies, or administers a substance during the execution; and |
---|
42 | 42 | | (2) any person or entity that manufactures, |
---|
43 | 43 | | transports, tests, procures, compounds, prescribes, dispenses, or |
---|
44 | 44 | | provides a substance or supplies used in an execution. |
---|
45 | 45 | | SECTION 3. The changes in law made by this Act apply only to |
---|
46 | 46 | | a request for information that is received by a governmental body or |
---|
47 | 47 | | an officer for public information on or after the effective date of |
---|
48 | 48 | | this Act. A request for information that was received before the |
---|
49 | 49 | | effective date of this Act is governed by the law in effect on the |
---|
50 | 50 | | date the request was received, and the former law is continued in |
---|
51 | 51 | | effect for that purpose. |
---|
52 | 52 | | SECTION 4. This Act takes effect immediately if it receives |
---|
53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
---|
54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
---|
56 | 56 | | Act takes effect September 1, 2015. |
