| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle I, Title 4, Government Code, is amended |

| 11 | 11 | | by adding Chapter 540 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 540. FEDERAL WAIVER FOR BLOCK GRANT FUNDING OF MEDICAID |

| 13 | 13 | | PROGRAM |
|---|
| 14 | 14 | | Sec. 540.001. DEFINITION. In this chapter, "Medicaid |
|---|
| 15 | 15 | | program" means the medical assistance program established under |
|---|
| 16 | 16 | | Title XIX, Social Security Act (42 U.S.C. Section 1396 et seq.). |

| 17 | 17 | | Sec. 540.002. FEDERAL AUTHORIZATION FOR BLOCK GRANT FUNDING |
|---|
| 18 | 18 | | SYSTEM FOR MEDICAID PROGRAM. Notwithstanding any other law, the |
|---|
| 19 | 19 | | executive commissioner shall negotiate with the United States |
|---|
| 20 | 20 | | secretary of health and human services, the federal Centers for |
|---|
| 21 | 21 | | Medicare and Medicaid Services, and other appropriate persons for |
|---|
| 22 | 22 | | purposes of seeking a waiver or other authorization necessary to |
|---|
| 23 | 23 | | operate the Medicaid program under a block grant funding system. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2015. |
