77 relating to seeking federal authorization to fund the Medicaid
88 program through a block grant funding system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle I, Title 4, Government Code, is amended
1111 by adding Chapter 540 to read as follows:
1212 CHAPTER 540. FEDERAL WAIVER FOR BLOCK GRANT FUNDING OF MEDICAID
1313 PROGRAM
1414 Sec. 540.001. DEFINITION. In this chapter, "Medicaid
1515 program" means the medical assistance program established under
1616 Title XIX, Social Security Act (42 U.S.C. Section 1396 et seq.).
1717 Sec. 540.002. FEDERAL AUTHORIZATION FOR BLOCK GRANT FUNDING
1818 SYSTEM FOR MEDICAID PROGRAM. Notwithstanding any other law, the
1919 executive commissioner shall negotiate with the United States
2020 secretary of health and human services, the federal Centers for
2121 Medicare and Medicaid Services, and other appropriate persons for
2222 purposes of seeking a waiver or other authorization necessary to
2323 operate the Medicaid program under a block grant funding system.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2015.
