66 AN ACT
77 relating to the authority of certain county employees to perform
88 payroll duties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 152.051, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 152.051. DEFINITION. In this subchapter, "county
1313 payroll officer" means the county auditor or other appropriate
1414 county officer or employee who issues paychecks to county or
1515 precinct personnel.
1616 SECTION 2. Sections 155.062(a), (b), and (d), Local
1717 Government Code, are amended to read as follows:
1818 (a) A request for an insurance deduction must:
1919 (1) be submitted to the county officer or employee
2020 authorized by the commissioners court to administer payroll
2121 deductions; and
2222 (2) state the amount to be deducted and the entity to
2323 which the amount is to be transferred.
2424 (b) A request remains in effect until the county officer or
2525 employee authorized by the commissioners court to administer the
2626 insurance deductions receives a notice of change.
2727 (d) If the amount of an applicable insurance premium is
2828 changed after the date the request for deduction is submitted, the
2929 county officer or employee authorized by the commissioners court to
3030 administer insurance deductions shall provide written notice of the
3131 change to each affected employee. The notice must be provided
3232 before the change takes effect.
3333 SECTION 3. Section 155.063(a), Local Government Code, is
3434 amended to read as follows:
3535 (a) The commissioners court may authorize:
3636 (1) a county officer or employee to administer the
3737 insurance deductions and to transfer an insurance deduction to the
3838 appropriate entity; and
3939 (2) the county officer or employee to charge the
4040 appropriate entity the costs of administering an insurance
4141 deduction.
4242 SECTION 4. Section 157.102(b), Local Government Code, is
4343 amended to read as follows:
4444 (b) A person who elects to participate in any aspect of the
4545 group health and related benefits plan and is required to make
4646 contributions toward the payment of the plan must authorize
4747 contributions to the fund by salary deduction. The authorization
4848 must be submitted in writing to the county officer or employee
4949 authorized by the commissioners court to administer payroll
5050 deductions. The authorization remains in effect as long as the
5151 person is required to make contributions toward the payment of the
5252 plan. If the amount of the person's required contributions changes
5353 after the date the request for deduction is submitted, the county
5454 shall notify the person of the change before the change takes
5555 effect. The county and any participating flood control district or
5656 hospital district may also contribute to the fund.
5757 SECTION 5. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2015.
