66 AN ACT
77 relating to standing for certain individuals to file a suit
88 affecting the parent-child relationship.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 102.006(c), Family Code, is amended to
1111 read as follows:
1212 (c) The limitations on filing suit imposed by this section
1313 do not apply to a person related to the child within the fourth
1414 degree by consanguinity as determined under Subchapter B, Chapter
1515 573, Government Code, [an adult sibling of the child, a grandparent
1616 of the child, an aunt who is a sister of a parent of the child, or an
1717 uncle who is a brother of a parent of the child] if the person [adult
1818 sibling, grandparent, aunt, or uncle] files an original suit or a
1919 suit for modification requesting managing conservatorship or
2020 adoption of the child not later than the 90th day after the date the
2121 parent-child relationship between the child and the parent is
2222 terminated in a suit filed by the Department of Family and
2323 Protective Services requesting the termination of the parent-child
2424 relationship.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
