BILL ANALYSIS H.B. 3865 By: Isaac Land & Resource Management Committee Report (Unamended) BACKGROUND AND PURPOSE Interested parties note that the extraterritorial jurisdiction of the City of Dripping Springs is exceptionally large and contains a significant amount of environmentally sensitive and scenic land. The parties further note that certain municipalities have the authority to annex an area on petition by property owners, which can often be an integral part of development agreements negotiated between property owners and municipalities. H.B. 3865 seeks to provide certain municipalities, such as the City of Dripping Springs, the tools with which to manage growth and development and promote orderly and responsible land use. CRIMINAL JUSTICE IMPACT It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 3865 amends the Local Government Code to increase from 1,599 to 5,000 the maximum population threshold of a general-law municipality authorized to annex an area that is adjacent to the annexing municipality, that is not being served with water or sewer service from a governmental entity, and for which a petition requesting annexation has been filed with the municipality.
