| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 43.032, Local Government |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 43.032. AUTHORITY OF CERTAIN [TYPE A] GENERAL-LAW |
|---|
| 13 | 13 | | MUNICIPALITIES TO ANNEX AN AREA ON [UPON] PETITION BY OWNERS. |

| 14 | 14 | | SECTION 2. Section 43.032(a), Local Government Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (a) The governing body of a general-law municipality with a |
|---|
| 17 | 17 | | population of 1,500 to 5,000 [1,599] may annex an area: |
|---|
| 18 | 18 | | (1) that is adjacent to the annexing municipality; |
|---|
| 19 | 19 | | (2) that is not being served with water or sewer |
|---|
| 20 | 20 | | service from a governmental entity; and |
|---|
| 21 | 21 | | (3) for which a petition requesting annexation has |
|---|
| 22 | 22 | | been filed with the municipality. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2015. |
