104 AN ACT
115 relating to the duration of protective orders issued in cases of
126 family violence against persons who are subsequently confined or
137 imprisoned.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 85.025(c), Family Code, is amended to
1610 read as follows:
1711 (c) If a person who is the subject of a protective order is
1812 confined or imprisoned on the date the protective order would
1913 expire under Subsection (a) or (a-1), or if the protective order
2014 would expire not later than the first anniversary of the date the
2115 person is released from confinement or imprisonment, the period for
2216 which the order is effective is extended, and the order expires on:
2317 (1) the first anniversary of the date the person is
2418 released from confinement or imprisonment, if the person was
2519 sentenced to confinement or imprisonment for more than five years;
2620 or
2721 (2) the second anniversary of the date the person is
2822 released from confinement or imprisonment, if the person was
2923 sentenced to confinement or imprisonment for five years or less.
3024 SECTION 2. Section 85.025(c), Family Code, as amended by
3125 this Act, applies only to a protective order issued on or after the
3226 effective date of this Act. A protective order issued before the
3327 effective date of this Act is governed by the law in effect on the
3428 date the order is issued, and the former law is continued in effect
3529 for that purpose.
3630 SECTION 3. This Act takes effect immediately if it receives
3731 a vote of two-thirds of all the members elected to each house, as
3832 provided by Section 39, Article III, Texas Constitution. If this
3933 Act does not receive the vote necessary for immediate effect, this
4034 Act takes effect September 1, 2015.
