10 | 10 | | revenue for the payment of certain obligations related to hotel |
---|
11 | 11 | | projects. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 351.102, Tax Code, is amended by |
---|
14 | 14 | | amending Subsection (b) and adding Subsection (b-2) to read as |
---|
15 | 15 | | follows: |
---|
16 | 16 | | (b) An eligible central municipality, [or] a municipality |
---|
17 | 17 | | with a population of 173,000 or more that is located within two or |
---|
18 | 18 | | more counties, or a municipality with a population of 96,000 or more |
---|
19 | 19 | | that is located in a county that borders Lake Palestine may pledge |
---|
20 | 20 | | the revenue derived from the tax imposed under this chapter from a |
---|
21 | 21 | | hotel project that is owned by or located on land owned by the |
---|
22 | 22 | | municipality or, in an eligible central municipality, by a |
---|
23 | 23 | | nonprofit corporation acting on behalf of an eligible central |
---|
24 | 24 | | municipality, and that is located within 1,000 feet of a convention |
---|
25 | 25 | | center facility owned by the municipality for the payment of bonds |
---|
26 | 26 | | or other obligations issued or incurred to acquire, lease, |
---|
27 | 27 | | construct, and equip the hotel and any facilities ancillary to the |
---|
28 | 28 | | hotel, including convention center entertainment-related |
---|
29 | 29 | | facilities, open public spaces used for connectivity, plazas, |
---|
30 | 30 | | restaurants, shops, street and water and sewer infrastructure, and |
---|
31 | 31 | | parking facilities within 1,000 feet of the hotel or convention |
---|
32 | 32 | | center facility. For bonds or other obligations issued under this |
---|
33 | 33 | | subsection, an eligible central municipality or a municipality |
---|
34 | 34 | | described by this subsection [with a population of 173,000 or more |
---|
35 | 35 | | that is located within two counties] may only pledge revenue or |
---|
36 | 36 | | other assets of the hotel project benefiting from those bonds or |
---|
37 | 37 | | other obligations. |
---|
38 | 38 | | (b-2) A municipality with a population of 96,000 or more |
---|
39 | 39 | | that is located in a county that borders Lake Palestine may not |
---|
40 | 40 | | pledge revenue under Subsection (b) or funds under Subsection (c) |
---|
41 | 41 | | for the payment of bonds or other obligations issued under this |
---|
42 | 42 | | section except for a hotel and facilities ancillary to the hotel |
---|
43 | 43 | | that are owned by the municipality and located on property that the |
---|
44 | 44 | | municipality owns or acquires with the proceeds from the bonds or |
---|
45 | 45 | | obligations for which the revenue or funds are pledged. |
---|
46 | 46 | | SECTION 2. This Act takes effect immediately if it receives |
---|
47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
---|
50 | 50 | | Act takes effect September 1, 2015. |
