88 AN ACT
99 relating to the authority of certain municipalities to pledge
1010 revenue for the payment of certain obligations related to hotel
1111 projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 351.102, Tax Code, is amended by
1414 amending Subsection (b) and adding Subsection (b-2) to read as
1515 follows:
1616 (b) An eligible central municipality, [or] a municipality
1717 with a population of 173,000 or more that is located within two or
1818 more counties, or a municipality with a population of 96,000 or more
1919 that is located in a county that borders Lake Palestine may pledge
2020 the revenue derived from the tax imposed under this chapter from a
2121 hotel project that is owned by or located on land owned by the
2222 municipality or, in an eligible central municipality, by a
2323 nonprofit corporation acting on behalf of an eligible central
2424 municipality, and that is located within 1,000 feet of a convention
2525 center facility owned by the municipality for the payment of bonds
2626 or other obligations issued or incurred to acquire, lease,
2727 construct, and equip the hotel and any facilities ancillary to the
2828 hotel, including convention center entertainment-related
2929 facilities, open public spaces used for connectivity, plazas,
3030 restaurants, shops, street and water and sewer infrastructure, and
3131 parking facilities within 1,000 feet of the hotel or convention
3232 center facility. For bonds or other obligations issued under this
3333 subsection, an eligible central municipality or a municipality
3434 described by this subsection [with a population of 173,000 or more
3535 that is located within two counties] may only pledge revenue or
3636 other assets of the hotel project benefiting from those bonds or
3737 other obligations.
3838 (b-2) A municipality with a population of 96,000 or more
3939 that is located in a county that borders Lake Palestine may not
4040 pledge revenue under Subsection (b) or funds under Subsection (c)
4141 for the payment of bonds or other obligations issued under this
4242 section except for a hotel and facilities ancillary to the hotel
4343 that are owned by the municipality and located on property that the
4444 municipality owns or acquires with the proceeds from the bonds or
4545 obligations for which the revenue or funds are pledged.
4646 SECTION 2. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2015.
