55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to adding certain substances to Penalty Group 2 of the
88 Texas Controlled Substances Act for purposes of criminal
99 prosecutions involving those substances, increasing penalties for
1010 the manufacture of, delivery of, or possession with the intent to
1111 deliver certain controlled substances, and a pilot program for
1212 field testing for controlled substances.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 411, Government Code, is amended by
1515 adding Subchapter P to read as follows:
1616 SUBCHAPTER P. FIELD TESTING PILOT PROGRAM
1717 Sec. 411.451. PURPOSE. The field testing pilot program is
1818 intended to examine the feasibility and desirability of equipping
1919 peace officers with field testing kits that identify whether a
2020 substance is a controlled substance prohibited under Chapter 481,
2121 Health and Safety Code.
2222 Sec. 411.452. PARTICIPATION. The department shall
2323 designate at least five local law enforcement agencies in various
2424 regions of the state to participate in the program and equip
2525 officers in those agencies with field testing kits.
2626 Sec. 411.453. ADMISSIBILITY. The result of a test from a
2727 field testing kit is not admissible in any criminal, civil, or
2828 administrative proceeding.
2929 Sec. 411.454. REPORT. Not later than December 1, 2016, the
3030 department shall submit to the governor, lieutenant governor,
3131 speaker of the house of representatives, and standing committees of
3232 the senate and house of representatives with jurisdiction over
3333 criminal justice issues a report evaluating:
3434 (1) the technical capabilities and accuracy of the
3535 technology used in the pilot program;
3636 (2) the potential impact on criminal justice in this
3737 state if field testing were implemented statewide;
3838 (3) any cost savings anticipated from the use of the
3939 field testing kits; and
4040 (4) the acceptance of field testing as evidence in the
4141 courts of this state.
4242 Sec. 411.455. EXPIRATION. This subchapter expires August
4343 31, 2017.
4444 SECTION 2. Section 481.103(a), Health and Safety Code, is
4545 amended to read as follows:
4646 (a) Penalty Group 2 consists of:
4747 (1) any quantity of the following hallucinogenic
4848 substances, their salts, isomers, and salts of isomers, unless
4949 specifically excepted, if the existence of these salts, isomers,
5050 and salts of isomers is possible within the specific chemical
5151 designation:
5252 alpha-ethyltryptamine;
5353 alpha-methyltryptamine;
5454 4-bromo-2, 5-dimethoxyamphetamine (some trade or
5555 other names: 4-bromo-2, 5-dimethoxy-alpha-methylphenethylamine;
5656 4-bromo-2, 5-DMA);
5757 4-bromo-2, 5-dimethoxyphenethylamine;
5858 Bufotenine (some trade and other names: 3-(beta-
5959 Dimethylaminoethyl)-5-hydroxyindole; 3-(2-dimethylaminoethyl)- 5-

156156 Amphetamine, its salts, optical isomers, and

183183 (i) substitution in the ring system to any
184184 extent (including alkyl, alkoxy, alkylenedioxy, haloalkyl, or
185185 halide substituents), whether or not further substituted in the
186186 ring system by other substituents;
187187 (ii) substitution at the 3-position with an
188188 alkyl substituent; or
189189 (iii) substitution at the 2-amino nitrogen
190190 atom with alkyl or dialkyl groups, or inclusion of the 2-amino
191191 nitrogen atom in a cyclic structure; and
192192 (B) by example, compounds such as:
193193 4-Methylmethcathinone (Also known as
194194 Mephedrone);
195195 3,4-Dimethylmethcathinone (Also known as
196196 3,4-DMMC);
197197 3-Fluoromethcathinone (Also known as 3-FMC);
198198 4-Fluoromethcathinone (Also known as
199199 Flephedrone);
200200 3,4-Methylenedioxy-N-methylcathinone (Also
201201 known as Methylone);
202202 3,4-Methylenedioxypyrovalerone (Also known
203203 as MDPV);
204204 alpha-Pyrrolidinopentiophenone (Also known
205205 as alpha-PVP);
206206 Naphthylpyrovalerone (Also known as

216216 SECTION 3. Section 481.119(a), Health and Safety Code, is
217217 amended to read as follows:
218218 (a) A person commits an offense if the person knowingly
219219 manufactures, delivers, or possesses with intent to deliver a
220220 controlled substance listed in a schedule by an action of the
221221 commissioner under this chapter but not listed in a penalty group.
222222 An offense under this subsection is a state jail felony [Class A
223223 misdemeanor].
224224 SECTION 4. Sections 481.134(d) and (e), Health and Safety
225225 Code, are amended to read as follows:
226226 (d) An offense otherwise punishable under Section
227227 481.112(b), 481.113(b), 481.114(b), 481.115(b), 481.116(b),
228228 481.1161(b)(3), 481.119(a), 481.120(b)(3), or 481.121(b)(3) is a
229229 felony of the third degree if it is shown on the trial of the offense
230230 that the offense was committed:
231231 (1) in, on, or within 1,000 feet of any real property
232232 that is owned, rented, or leased to a school or school board, the
233233 premises of a public or private youth center, or a playground; or
234234 (2) on a school bus.
235235 (e) An offense otherwise punishable under Section
236236 481.117(b), [481.119(a),] 481.120(b)(2), or 481.121(b)(2) is a
237237 state jail felony if it is shown on the trial of the offense that the
238238 offense was committed:
239239 (1) in, on, or within 1,000 feet of any real property
240240 that is owned, rented, or leased to a school or school board, the
241241 premises of a public or private youth center, or a playground; or
242242 (2) on a school bus.
243243 SECTION 5. The change in law made by this Act applies only
244244 to an offense committed on or after the effective date of this Act.
245245 An offense committed before the effective date of this Act is
246246 governed by the law in effect when the offense was committed, and
247247 the former law is continued in effect for that purpose. For
248248 purposes of this section, an offense was committed before the
249249 effective date of this Act if any element of the offense occurred
250250 before that date.
251251 SECTION 6. This Act takes effect September 1, 2015.
