66 relating to identification and implementation of hospital funding

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1010 amended by adding Section 531.02117 to read as follows:
1111 Sec. 531.02117. HOSPITAL FUNDING SOLUTIONS. (a) The
1212 commission, in consultation with the Department of State Health
1313 Services, shall conduct a study to identify solutions for
1414 stabilizing hospital funding in the state that at minimum
1515 considers:
1616 (1) Medicaid reimbursements paid to hospitals in this
1717 state for services provided by the hospitals; and
1818 (2) payments made under the disproportionate share
1919 hospitals supplemental payment program to hospitals in this state.
2020 (b) The commission, in consultation with the Department of
2121 State Health Services and based on the study conducted under this
2222 section, shall develop proposals designed to provide long-term
2323 funding solutions related to the Medicaid program for hospitals in
2424 this state. To the extent authorized by law and with prior written
2525 approval from the Legislative Budget Board and the Governor, the
2626 commission may implement the proposals.
2727 (c) Not later than December 1, 2016, the commission shall
2828 submit a report based on the study conducted and proposals
2929 developed under this section to the governor, the lieutenant
3030 governor, and the legislature. The report must:
3131 (1) describe the proposals developed under Subsection
3232 (b) and:
3333 (A) identify the proposals the commission has
3434 implemented; and
3535 (B) for each proposal the commission has not
3636 implemented, identify any changes in law necessary for
3737 implementation.
3838 (d) The commission may adopt rules as necessary to implement
3939 this section.
4040 (g) This section expires September 1, 2017.
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2015.
