| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 10 | 10 | | amended by adding Section 531.02117 to read as follows: |
|---|
| 11 | 11 | | Sec. 531.02117. HOSPITAL FUNDING SOLUTIONS. (a) The |
|---|
| 12 | 12 | | commission, in consultation with the Department of State Health |
|---|
| 13 | 13 | | Services, shall conduct a study to identify solutions for |
|---|
| 14 | 14 | | stabilizing hospital funding in the state that at minimum |
|---|
| 15 | 15 | | considers: |
|---|
| 16 | 16 | | (1) Medicaid reimbursements paid to hospitals in this |
|---|
| 17 | 17 | | state for services provided by the hospitals; and |
|---|
| 18 | 18 | | (2) payments made under the disproportionate share |
|---|
| 19 | 19 | | hospitals supplemental payment program to hospitals in this state. |
|---|
| 20 | 20 | | (b) The commission, in consultation with the Department of |
|---|
| 21 | 21 | | State Health Services and based on the study conducted under this |
|---|
| 22 | 22 | | section, shall develop proposals designed to provide long-term |
|---|
| 23 | 23 | | funding solutions related to the Medicaid program for hospitals in |
|---|
| 24 | 24 | | this state. To the extent authorized by law and with prior written |
|---|
| 25 | 25 | | approval from the Legislative Budget Board and the Governor, the |
|---|
| 26 | 26 | | commission may implement the proposals. |
|---|
| 27 | 27 | | (c) Not later than December 1, 2016, the commission shall |
|---|
| 28 | 28 | | submit a report based on the study conducted and proposals |
|---|
| 29 | 29 | | developed under this section to the governor, the lieutenant |
|---|
| 30 | 30 | | governor, and the legislature. The report must: |
|---|
| 31 | 31 | | (1) describe the proposals developed under Subsection |
|---|
| 32 | 32 | | (b) and: |
|---|
| 33 | 33 | | (A) identify the proposals the commission has |
|---|
| 34 | 34 | | implemented; and |
|---|
| 35 | 35 | | (B) for each proposal the commission has not |
|---|
| 36 | 36 | | implemented, identify any changes in law necessary for |
|---|
| 37 | 37 | | implementation. |
|---|
| 38 | 38 | | (d) The commission may adopt rules as necessary to implement |
|---|
| 39 | 39 | | this section. |
|---|
| 40 | 40 | | (g) This section expires September 1, 2017. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2015. |
