77 relating to water and electric utility services provided to certain

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subtitle C, Title 13, Local
1111 Government Code, is amended to read as follows:
1212 SUBTITLE C. WATER AND ELECTRICITY PROVISIONS APPLICABLE [APPLYING]
1313 TO MORE THAN ONE TYPE OF LOCAL GOVERNMENT
1414 SECTION 2. The heading to Chapter 580, Local Government
1515 Code, is amended to read as follows:
1616 CHAPTER 580. MISCELLANEOUS PROVISIONS RELATING TO [MUNICIPAL AND
1717 COUNTY] WATER AND ELECTRIC UTILITY SERVICES APPLICABLE TO MORE THAN
1818 ONE TYPE OF LOCAL GOVERNMENT
1919 SECTION 3. Chapter 580, Local Government Code, is amended
2020 by adding Section 580.005 to read as follows:
2121 Sec. 580.005. PROVIDING WATER AND ELECTRIC UTILITY SERVICES
2222 TO CERTAIN FEDERAL AGENCIES PROHIBITED. (a) In this section,
2323 "federal data collection and surveillance agency" means a federal
2424 agency that is involved in the routine surveillance or collection
2525 and storage of bulk telephone or e-mail records or related metadata
2626 concerning any citizen of the United States and that claims the
2727 legal authority to collect and store the bulk telephone or e-mail
2828 records or metadata concerning any citizen of the United States
2929 without the citizen's consent or a search warrant that describes
3030 the person, place, or thing to be searched or seized.
3131 (b) A political subdivision may not provide water or electric
3232 utility service to a federal data collection and surveillance
3333 agency or to the property or a facility of another person used to
3434 support a federal data collection and surveillance agency for
3535 information collection or storage.
3636 (c) A political subdivision that has outstanding bonds that
3737 are payable from pledged water or electric utility revenue is
3838 required to terminate the water or electric utility service, as
3939 applicable, to a federal data collection and surveillance agency
4040 only when the bonds are repaid.
4141 SECTION 4. Section 580.005, Local Government Code, as added
4242 by this Act, may not be construed to impair an obligation under a
4343 contract entered into on or after the effective date of this Act. A
4444 political subdivision may fulfill the subdivision's obligations
4545 under a contract entered into before that date but may not extend
4646 such a contract beyond the contract's original term.
4747 SECTION 5. This Act takes effect September 1, 2015.
