| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subtitle C, Title 13, Local |

| 19 | 19 | | SECTION 3. Chapter 580, Local Government Code, is amended |

| 20 | 20 | | by adding Section 580.005 to read as follows: |

| 21 | 21 | | Sec. 580.005. PROVIDING WATER AND ELECTRIC UTILITY SERVICES |
|---|
| 22 | 22 | | TO CERTAIN FEDERAL AGENCIES PROHIBITED. (a) In this section, |
|---|
| 23 | 23 | | "federal data collection and surveillance agency" means a federal |
|---|
| 24 | 24 | | agency that is involved in the routine surveillance or collection |
|---|
| 25 | 25 | | and storage of bulk telephone or e-mail records or related metadata |
|---|
| 26 | 26 | | concerning any citizen of the United States and that claims the |
|---|
| 27 | 27 | | legal authority to collect and store the bulk telephone or e-mail |
|---|
| 28 | 28 | | records or metadata concerning any citizen of the United States |
|---|
| 29 | 29 | | without the citizen's consent or a search warrant that describes |
|---|
| 30 | 30 | | the person, place, or thing to be searched or seized. |
|---|
| 31 | 31 | | (b) A political subdivision may not provide water or electric |
|---|
| 32 | 32 | | utility service to a federal data collection and surveillance |
|---|
| 33 | 33 | | agency or to the property or a facility of another person used to |
|---|
| 34 | 34 | | support a federal data collection and surveillance agency for |
|---|
| 35 | 35 | | information collection or storage. |
|---|
| 36 | 36 | | (c) A political subdivision that has outstanding bonds that |
|---|
| 37 | 37 | | are payable from pledged water or electric utility revenue is |
|---|
| 38 | 38 | | required to terminate the water or electric utility service, as |
|---|
| 39 | 39 | | applicable, to a federal data collection and surveillance agency |
|---|
| 40 | 40 | | only when the bonds are repaid. |
|---|
| 41 | 41 | | SECTION 4. Section 580.005, Local Government Code, as added |
|---|
| 42 | 42 | | by this Act, may not be construed to impair an obligation under a |
|---|
| 43 | 43 | | contract entered into on or after the effective date of this Act. A |
|---|
| 44 | 44 | | political subdivision may fulfill the subdivision's obligations |
|---|
| 45 | 45 | | under a contract entered into before that date but may not extend |
|---|
| 46 | 46 | | such a contract beyond the contract's original term. |
|---|
| 47 | 47 | | SECTION 5. This Act takes effect September 1, 2015. |
