66 AN ACT
77 relating to authorizing an optional county fee for vehicle
88 registration to fund certain transportation projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 502, Transportation Code,
1111 is amended by adding Section 502.4015 to read as follows:
1212 Sec. 502.4015. OPTIONAL COUNTY FEE FOR CERTAIN
1313 TRANSPORTATION PROJECTS. (a) In addition to any other fee
1414 authorized under this chapter, the commissioners court of a county
1515 by order may impose an additional fee, not to exceed $10, for
1616 registering a vehicle in the county.
1717 (b) A vehicle that may be registered under this chapter
1818 without payment of a registration fee may be registered in a county
1919 imposing a fee under this section without payment of the additional
2020 fee.
2121 (c) A fee imposed under this section may take effect and be
2222 removed in accordance with the provisions of Section 502.401.
2323 (d) The county assessor-collector of a county imposing a fee
2424 under this section shall collect the additional fee for a vehicle
2525 when other fees imposed under this chapter are collected. The
2626 county may use the fee revenue only to fund a nontolled
2727 transportation project that:
2828 (1) relieves congestion;
2929 (2) improves safety; or
3030 (3) addresses air quality.
3131 (e) The department shall collect the additional fee on a
3232 vehicle that is owned by a resident of a county imposing a fee under
3333 this section and that, under this chapter, must be registered
3434 directly with the department. The department shall send all fees
3535 collected for a county under this subsection to the county
3636 treasurer for use as provided by Subsection (d).
3737 (f) The board shall adopt rules and develop forms necessary
3838 to administer registration by mail for a vehicle being registered
3939 in a county imposing a fee under this section.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2015.
