| 8 | 8 | | registration to fund certain transportation projects. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 502, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 502.4015 to read as follows: |
|---|
| 12 | 12 | | Sec. 502.4015. OPTIONAL COUNTY FEE FOR CERTAIN |
|---|
| 13 | 13 | | TRANSPORTATION PROJECTS. (a) In addition to any other fee |
|---|
| 14 | 14 | | authorized under this chapter, the commissioners court of a county |
|---|
| 15 | 15 | | by order may impose an additional fee, not to exceed $10, for |
|---|
| 16 | 16 | | registering a vehicle in the county. |
|---|
| 17 | 17 | | (b) A vehicle that may be registered under this chapter |
|---|
| 18 | 18 | | without payment of a registration fee may be registered in a county |
|---|
| 19 | 19 | | imposing a fee under this section without payment of the additional |
|---|
| 20 | 20 | | fee. |
|---|
| 21 | 21 | | (c) A fee imposed under this section may take effect and be |
|---|
| 22 | 22 | | removed in accordance with the provisions of Section 502.401. |
|---|
| 23 | 23 | | (d) The county assessor-collector of a county imposing a fee |
|---|
| 24 | 24 | | under this section shall collect the additional fee for a vehicle |
|---|
| 25 | 25 | | when other fees imposed under this chapter are collected. The |
|---|
| 26 | 26 | | county may use the fee revenue only to fund a nontolled |
|---|
| 27 | 27 | | transportation project that: |
|---|
| 28 | 28 | | (1) relieves congestion; |
|---|
| 29 | 29 | | (2) improves safety; or |
|---|
| 30 | 30 | | (3) addresses air quality. |
|---|
| 31 | 31 | | (e) The department shall collect the additional fee on a |
|---|
| 32 | 32 | | vehicle that is owned by a resident of a county imposing a fee under |
|---|
| 33 | 33 | | this section and that, under this chapter, must be registered |
|---|
| 34 | 34 | | directly with the department. The department shall send all fees |
|---|
| 35 | 35 | | collected for a county under this subsection to the county |
|---|
| 36 | 36 | | treasurer for use as provided by Subsection (d). |
|---|
| 37 | 37 | | (f) The board shall adopt rules and develop forms necessary |
|---|
| 38 | 38 | | to administer registration by mail for a vehicle being registered |
|---|
| 39 | 39 | | in a county imposing a fee under this section. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2015. |
