5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to allowing certain providers of eye health care services
8	8	to enroll as Medicaid providers.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subchapter B, Chapter 531, Government Code, is
11	11	amended by adding Section 531.02119 to read as follows:
12	12	Sec. 531.02119. MEDICAID ENROLLMENT AND CREDENTIALING OF
13	13	CERTAIN EYE HEALTH CARE PROVIDERS. (a) This section applies to:
14	14	(1) an optometrist who is licensed by the Texas
15	15	Optometry Board;
16	16	(2) a therapeutic optometrist who is licensed by the
17	17	Texas Optometry Board; and
18	18	(3) an ophthalmologist who is licensed by the Texas
19	19	Medical Board.
20	20	(b) The commission may not prevent a provider to whom this
21	21	section applies from enrolling as a Medicaid provider if the
22	22	provider:
23	23	(1) joins an established practice of a health care
24	24	provider or provider group that:
25	25	(A) has a contract with a managed care
26	26	organization to provide health care services to recipients under
27	27	Chapter 533; or
28	28	(B) provides health care services under the
29	29	Medicaid program under a fee-for-service arrangement;
30	30	(2) applies to be an enrolled provider under the
31	31	Medicaid program;
32	32	(3) if applicable:
33	33	(A) applies for credentialing with the
34	34	appropriate managed care organization; and
35	35	(B) complies with the requirements of the
36	36	contract between the provider or the provider's group and the
37	37	applicable managed care organization; and
38	38	(4) complies with all other applicable requirements
39	39	related to being a Medicaid provider.
40	40	SECTION 2. If before implementing any provision of this Act
41	41	a state agency determines that a waiver or authorization from a
42	42	federal agency is necessary for implementation of that provision,
43	43	the agency affected by the provision shall request the waiver or
44	44	authorization and may delay implementing that provision until the
45	45	waiver or authorization is granted.
46	46	SECTION 3. This Act takes effect immediately if it receives
47	47	a vote of two-thirds of all the members elected to each house, as
48	48	provided by Section 39, Article III, Texas Constitution. If this
49	49	Act does not receive the vote necessary for immediate effect, this
50	50	Act takes effect September 1, 2015.
