55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to allowing certain providers of eye health care services
88 to enroll as Medicaid providers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.02119 to read as follows:
1212 Sec. 531.02119. MEDICAID ENROLLMENT AND CREDENTIALING OF
1313 CERTAIN EYE HEALTH CARE PROVIDERS. (a) This section applies to:
1414 (1) an optometrist who is licensed by the Texas
1515 Optometry Board;
1616 (2) a therapeutic optometrist who is licensed by the
1717 Texas Optometry Board; and
1818 (3) an ophthalmologist who is licensed by the Texas
1919 Medical Board.
2020 (b) The commission may not prevent a provider to whom this
2121 section applies from enrolling as a Medicaid provider if the
2222 provider:
2323 (1) joins an established practice of a health care
2424 provider or provider group that:
2525 (A) has a contract with a managed care
2626 organization to provide health care services to recipients under
2727 Chapter 533; or
2828 (B) provides health care services under the
2929 Medicaid program under a fee-for-service arrangement;
3030 (2) applies to be an enrolled provider under the
3131 Medicaid program;
3232 (3) if applicable:
3333 (A) applies for credentialing with the
3434 appropriate managed care organization; and
3535 (B) complies with the requirements of the
3636 contract between the provider or the provider's group and the
3737 applicable managed care organization; and
3838 (4) complies with all other applicable requirements
3939 related to being a Medicaid provider.
4040 SECTION 2. If before implementing any provision of this Act
4141 a state agency determines that a waiver or authorization from a
4242 federal agency is necessary for implementation of that provision,
4343 the agency affected by the provision shall request the waiver or
4444 authorization and may delay implementing that provision until the
4545 waiver or authorization is granted.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2015.
