66 AN ACT
77 relating to fetal alcohol syndrome information provided to pregnant
88 patients.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 161, Health and Safety Code, is amended
1111 by adding Subchapter X to read as follows:
1212 SUBCHAPTER X. INFORMATION FOR PREGNANT PATIENTS
1313 Sec. 161.701. DEFINITIONS. In this subchapter:
1414 (1) "Department" means the Department of State Health
1515 Services.
1616 (2) "Health care provider" means:
1717 (A) a physician licensed to practice medicine in
1818 this state;
1919 (B) a physician assistant licensed under Chapter
2020 204, Occupations Code;
2121 (C) a midwife licensed under Chapter 203,
2222 Occupations Code;
2323 (D) an advanced practice nurse as defined by
2424 Section 301.152, Occupations Code;
2525 (E) a hospital licensed under Chapter 241; or
2626 (F) a birthing center licensed under Chapter 244.
2727 (3) "Medically accurate information" means
2828 information that is:
2929 (A) verified or supported by the weight of
3030 research conducted in compliance with accepted scientific methods;
3131 (B) published in peer reviewed journals, if
3232 appropriate; and
3333 (C) recognized as accurate, objective, and
3434 complete by mainstream professional organizations and agencies
3535 with expertise in the relevant field, including:
3636 (i) the Centers for Disease Control and
3737 Prevention of the United States Public Health Service;
3838 (ii) the American College of Obstetricians
3939 and Gynecologists;
4040 (iii) the American Academy of Pediatrics;
4141 and
4242 (iv) the surgeon general of the United
4343 States Department of Health and Human Services.
4444 Sec. 161.702. INFORMATIONAL MATERIAL PROVIDED TO PREGNANT
4545 PATIENT. (a) A health care provider that provides care to a
4646 pregnant patient shall, during the patient's first visit with the
4747 provider concerning the pregnancy, make available to the patient
4848 informational material that includes medically accurate
4949 information about the risks of drinking alcohol while pregnant,
5050 including fetal alcohol syndrome.
5151 (b) A health care provider may use the informational
5252 material provided on the department's Internet website or
5353 alternative informational material that provides the information
5454 required by Subsection (a).
5555 Sec. 161.703. DUTIES OF DEPARTMENT. (a) The department
5656 shall:
5757 (1) establish guidelines for the provision of the
5858 information required by Section 161.702;
5959 (2) make available on the department's Internet
6060 website a printable version of the medically accurate informational
6161 material required by Section 161.702(a); and
6262 (3) make the informational material required by
6363 Section 161.702 available for distribution to health care
6464 providers, including at the request of a provider.
6565 (b) The department may make available online and distribute
6666 an existing medically accurate publication created by the
6767 department or another health and human services agency as the
6868 informational material required by Section 161.702.
6969 Sec. 161.704. LIABILITY NOT CREATED. This subchapter does
7070 not create an obligation or duty that provides a basis for a cause
7171 of action against a health care provider. A health care provider is
7272 immune from administrative, civil, or criminal liability with
7373 respect to an action taken or not taken under this subchapter.
7474 SECTION 2. Not later than October 1, 2015, the Department of
7575 State Health Services shall make available the informational
7676 material required by Subchapter X, Chapter 161, Health and Safety
7777 Code, as added by this Act.
7878 SECTION 3. Notwithstanding Subchapter X, Chapter 161,
7979 Health and Safety Code, as added by this Act, a health care provider
8080 is not required to comply with the requirements of Section 161.702,
8181 Health and Safety Code, as added by this Act, before January 1,
8282 2016.
8383 SECTION 4. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2015.
