| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 49, Penal Code, is amended by adding |
|---|
| 12 | 12 | | Section 49.091 to read as follows: |
|---|
| 13 | 13 | | Sec. 49.091. VIOLATION OF CONDITION OF BOND OR COMMUNITY |
|---|
| 14 | 14 | | SUPERVISION OR COURT ORDER RELATING TO IGNITION INTERLOCK |
|---|
| 15 | 15 | | DEVICE. (a) A person commits an offense if the person violates a |
|---|
| 16 | 16 | | condition of bond imposed under Article 17.441, Code of Criminal |
|---|
| 17 | 17 | | Procedure, a condition of community supervision imposed under |
|---|
| 18 | 18 | | Section 13(i), Article 42.12, Code of Criminal Procedure, or a |
|---|
| 19 | 19 | | court order issued under Section 49.09(h). |
|---|
| 20 | 20 | | (b) An offense under this section is a Class B misdemeanor, |
|---|
| 21 | 21 | | except that the offense is a Class A misdemeanor if it is shown on |
|---|
| 22 | 22 | | the trial of the offense that the defendant has previously been |
|---|
| 23 | 23 | | convicted of an offense under this section. |

| 24 | 24 | | SECTION 2. The change in law made by this Act in adding |
|---|
| 25 | 25 | | Section 49.091, Penal Code, applies only to a condition of bond or |
|---|
| 26 | 26 | | community supervision imposed, or a court order issued, on or after |
|---|
| 27 | 27 | | the effective date of this Act. A condition imposed or court order |
|---|
| 28 | 28 | | issued before the effective date of this Act is governed by the law |
|---|
| 29 | 29 | | in effect on the date the condition was imposed or the order was |
|---|
| 30 | 30 | | issued, and the former law is continued in effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2015. |
