55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a criminal penalty for violating a condition of bond,
88 condition of community supervision, or court order requiring
99 installation of an ignition interlock device.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 49, Penal Code, is amended by adding
1212 Section 49.091 to read as follows:
1313 Sec. 49.091. VIOLATION OF CONDITION OF BOND OR COMMUNITY
1414 SUPERVISION OR COURT ORDER RELATING TO IGNITION INTERLOCK
1515 DEVICE. (a) A person commits an offense if the person violates a
1616 condition of bond imposed under Article 17.441, Code of Criminal
1717 Procedure, a condition of community supervision imposed under
1818 Section 13(i), Article 42.12, Code of Criminal Procedure, or a
1919 court order issued under Section 49.09(h).
2020 (b) An offense under this section is a Class B misdemeanor,
2121 except that the offense is a Class A misdemeanor if it is shown on
2222 the trial of the offense that the defendant has previously been
2323 convicted of an offense under this section.
2424 SECTION 2. The change in law made by this Act in adding
2525 Section 49.091, Penal Code, applies only to a condition of bond or
2626 community supervision imposed, or a court order issued, on or after
2727 the effective date of this Act. A condition imposed or court order
2828 issued before the effective date of this Act is governed by the law
2929 in effect on the date the condition was imposed or the order was
3030 issued, and the former law is continued in effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2015.
